Jordan/West Bank reunification key to peace in Jerusalem

Separating Jews and Arabs in former Palestine – first decreed by the League of Nations 100 years ago under article 25 of the Mandate for Palestine and subsequently endorsed by the United Nations in its 1947 Partition Plan - has become even more urgent following:

  • the outpouring of rabid Jew-hatred emanating from the Temple Mount in Jerusalem during Ramadan
  • three Jewish fathers being murdered - leaving 16 Jewish children fatherless - and seven more Jews being wounded - in an axe and knife wielding bloodbath perpetrated by two Arabs

Violent Arab riots against Jews first occurred in 1920 and 1921. Secretary of State for the Colonies -Winston Churchill - in his White Paper dated June 3, 1922 - had sought to allay Arab fears of a Jewish takeover of all of Palestine

"Unauthorized statements have been made to the effect that the purpose in view is to create a wholly Jewish Palestine. Phrases have been used such as that Palestine is to become "as Jewish as England is English." His Majesty's Government regard any such expectation as impracticable and have no such aim in view. Nor have they at any time contemplated, as appears to be feared by the Arab delegation, the disappearance or the subordination of the Arabic population, language, or culture in Palestine. They would draw attention to the fact that the terms of the [Balfour -ed]Declaration referred to do not contemplate that Palestine as a whole should be converted into a Jewish National Home, but that such a Home should be founded 'in Palestine.'"

As a result - Article 25 was inserted in the Mandate adopted by the League of Nations on July 24, 1922:

  • Restricting the reconstitution of the Jewish National Home after 3000 years in just 22% of Palestine located west of the Jordan River - today called Israel, Judea and Samaria (West Bank) and Gaza
  • Granting Arab self-determination in the remaining 78% of Palestine located east of the Jordan River--today called Jordan.

The Jews accepted - albeit reluctantly - article 25’s inclusion in the Mandate.  The Arabs never did -demanding 100% of Palestine - not the 78% they were allocated under article 25

100 years later:

  • Israel exercises sovereignty in 17% of former Palestine
  • Jordan exercises sovereignty in 78% of former Palestine
  • Sovereignty in 5% of former Palestine west of the Jordan River - Judea and Samaria (West Bank) and Gaza - remains unallocated.

According to a recent poll conducted by the Palestinian Center for Policy and Survey Research:

  • 32% of Palestinian Arabs living in Judea and Samaria (West Bank) and Gaza support one state west of the Jordan River with equal rights for Jews and Arabs
  • 44% think that armed struggle is the most effective means of ending the "Israeli occupation"

This proposed one-state solution - bringing Arabs and Jews together - is only agreed to by 10% of Israelis. However an alternative one-state solution that separates Jews and Arabs - reducing conflict- is feasible and involves: Direct negotiations between Jordan and Israel - the two successor states to the Mandate for Palestine - to redraw their current international border - which would result in:

  • Gaza plus the heavily-populated Arab areas of Judea and Samaria (West Bank) as existed between 1950 and 1967 - becoming part of Jordan
  • the heavily-populated Jewish areas of Judea and Samaria (West Bank) becoming part of Israel
  • no Arab or Jew having to leave his current home
  • Jordan being affirmed as Custodian of the Islamic Holy Shrines in Jerusalem
  • Freedom of worship in Jerusalem for Jews, Christians and Moslems

The League of Nations and United Nations mutually-agreed destination - one Jewish State and one Arab state in former Palestine - will have finally been reached.

Jordan, Arab League and UN fuel Jew-hatred on Temple Mount

Jordan, the Arab League and the UN's failure to condemn the virulent Jew-hatred on public display during Ramadan at Islam's third holiest religious site – the Al-Aqsa Mosque – located on the Temple Mount in Jerusalem - is despicable.

Thousands of rioters defiled what is venerated as a Muslim Holy Shrine - converting it into a rallying point for flag-waving slogan-shouting Palestinian Arabs armed with rocks and Molotov cocktails to vent their hatred against Jews pictured below:

Clauses 9.1 and 9.2 of the 1994 Israel-Jordan Peace Treaty state:

9.1. Each Party will provide freedom of access to places of religious and historical significance.

9.2. In this regard, in accordance with the Washington Declaration, Israel respects the present special role of the Hashemite Kingdom of Jordan in Muslim Holy shrines in Jerusalem. When negotiations on the permanent status will take place, Israel will give high priority to the Jordanian historic role in these shrines.

The reaction in the Jordanian Parliament to the rioting - expressed by Jordan's Prime Minister - Bisher Al-Khasawneh - was incredulous:

"I salute every Palestinian, and all the employees of the Jordanian Islamic Waqf, who proudly stand like minarets, hurling their stones in a volley of clay at the Zionist sympathizers defiling the Al-Aqsa Mosque under the protection of the Israeli occupation government"

Instead of publicly condemning his Prime Minister's provocative and offensive remarks and pledging to uphold the terms of Jordan's Peace Treaty with Israel – Jordan's King Abdullah phoned Egyptian President Abdel-Fattah el-Sisi when they:

"stressed the need to cease all illegal and provocative Israeli measures in Al-Aqsa Mosque."

The Arab League called on Israel to end Jewish prayer on the Temple Mount - warning it was a flagrant affront to Muslim feelings that could trigger wider conflict.

Jordanian Foreign Minister Ayman al Safadi - standing alongside Arab League chief Ahmed Aboul Gheit after an emergency Arab League meeting in Amman stated:

"Our demands are clear that Al-Aqsa and Haram al Sharif in all its area is a sole place of worship for Muslims,"
Aboul Gheit reportedly said Israel was violating a centuries-old policy according to which non-Muslims may visit the Al-Aqsa compound, Islam's third most sacred site after Mecca and Medina, but not pray there. The briefing to the UN Security Council by Tor Wennesland Special Coordinator for the Middle East Peace Process was equally disturbing.

"... on 21 April, Jordan convened a ministerial of the Arab League to discuss tensions at the Holy Sites. The Committee issued a statement following the meeting calling for "the respect of the legal and historic status quo."

The legal status quo grants freedom of access for Jews and Christians worldwide to the Temple Mount which the rioters were preventing. The historic status quo involves the continuation of Islam's centuries old practice - agreed to by Israel since 1967 in the hope of helping end the Arab-Israel conflict –that now requires Jews to not mutter one syllable in prayer silently whilst on the Temple Mount – Judaism's holiest site.

Wennesland amazingly told the Security Council:

"I welcome statements by senior Israeli officials reiterating Israel's commitment to upholding the status quo and ensuring that only Muslims would be allowed to pray on the Holy Esplanade."

The UN's abject surrender in not specifically demanding that Jordan ensure freedom of access for all people to the Temple Mount under the Jordan-Israel Peace Treaty is deplorable

That the UN should welcome the continuation of an ancient Islamic supremacist practice excluding non-Muslims praying on the Temple Mount represents the endorsement of a policy that in today's world smacks of racism and apartheid deserving of condemnation.

Jew-hatred is a corrosive human condition that remains incurable.

Palestine - PLO And Hamas Threaten Split Over Islamic State

[Published 6 July 2014]

The declaration of the Islamic State on the first day of the holy fasting month of Ramadan threatens once again to embroil the recently reconciled PLO and Hamas in renewed and violent confrontation after just ending their seven year internecine feud - destroying any hope of ever achieving a Palestinian Arab State between Jordan and Israel.

The Islamic State is a self styled Caliphate - a system of rule that ended in 1924 after the fall of the Ottoman Empire.

The statement declaring its establishment reads:
“Here the flag of the Islamic State ... rises and flutters. Its shade covers land from Aleppo [Syria] and Diyala [Iraq]. The infidels are disgraced. The Sunnis are masters and are esteemed. The people of heresy are humiliated. The Sharia penalties are implemented, all of them. The front lines are defended, crosses and graves demolished. Governors and judges have been appointed, a tax has been enforced and courts will resolve disputes and complaints.”

The Islamic State already controls large swathes of northern Iraq after a sustained assault which began with the overthrow of Iraqi control of the country’s second largest city of Mosul, near the Syrian border, on June 9.

Over the last two years it has established a strong presence in parts of Syria, controlling key oil fields in eastern Syria in the area bordering Iraq, levying taxes and other penalties and implementing strict Sharia law on besieged communities.

At its head as Caliph - the self-proclaimed successor to the Prophet Mohammed - is Abu Bakr al-Baghdadi - whose spokesman has made his intentions clear:
“The time has come for those generations that were drowning in oceans of disgrace, being nursed on the milk of humiliation, and being ruled by the vilest of all people, after their long slumber in the darkness of neglect—the time has come for them to rise,”

Will Hamas rise and throw its weight behind this new Caliph - given the following provisions of Article 11 of the Hamas Charter:
“... Palestine is an Islamic Waqf throughout all generations and to the Day of Resurrection. Who can presume to speak for all Islamic Generations to the Day of Resurrection? This is the status [of the land] in Islamic Shari’a, and it is similar to all lands conquered by Islam by force, and made thereby Waqf lands upon their conquest, for all generations of Muslims until the Day of Resurrection. This [norm] has prevailed since the commanders of the Muslim armies completed the conquest of Syria and Iraq, and they asked the Caliph of Muslims, ‘Umar Ibn al-Khattab, for his view of the conquered land, whether it should be partitioned between the troops or left in the possession of its population, or otherwise. Following discussions and consultations between the Caliph of Islam, ‘Umar Ibn al-Khattab, and the Companions of the Messenger of Allah, be peace and prayer upon him, they decided that the land should remain in the hands of its owners to benefit from it and from its wealth; but the control of the land and the land itself ought to be endowed as a Waqf [in perpetuity] for all generations of Muslims until the Day of Resurrection. The ownership of the land by its owners is only one of usufruct, and this Waqf will endure as long as Heaven and earth last. Any demarche in violation of this law of Islam, with regard to Palestine, is baseless and reflects on its perpetrators.”

Hamas has reserved the right to resist the temptation to blindly pledge its allegiance to this newly declared Caliph and the Islamic State under article 23 of the Hamas Charter:
“The Hamas views the other Islamic movements with respect and appreciation. Even when it differs from them in one aspect or another or on one concept or another, it agrees with them in other aspects and concepts. It reads those movements as included in the framework of striving [for the sake of Allah], as long as they hold sound intentions and abide by their devotion to Allah, and as along as their conduct remains within the perimeter of the Islamic circle.”

The PLO also needs to reassess its recently established symbiotic relationship with Hamas given that there appears to be far more common ground in the stated aims and objectives of Hamas and the Islamic State than exists between Hamas and the PLO.

This view is reinforced by Article 27 of the Hamas Charter:
” Under the influence of the circumstances which surrounded the founding of the PLO, and the ideological invasion which has swept the Arab world since the rout of the Crusades, and which has been reinforced by Orientalism and the Christian Mission, the PLO has adopted the idea of a Secular State, and so we think of it. Secular thought is diametrically opposed to religious thought. Thought is the basis for positions, for modes of conduct and for resolutions. Therefore, in spite of our appreciation for the PLO and its possible transformation in the future, and despite the fact that we do not denigrate its role in the Arab-Israeli conflict, we cannot substitute it for the Islamic nature of Palestine by adopting secular thought.”
Hamas and the PLO have always been perfectly up front and transparent in their declared aims and objectives. The problem has always been the inability of the West to believe them.

Maybe they now will.

God help them if they don’t.

Palestine - Where To From Here?

[Published 24 August 2012]

Israel’s Foreign Minister - Avigdor Liberman - has written to Her Excellency Baroness Ashton - High Representative of the European Union for Foreign Affairs and Security:
“to demonstrate Israel’s goodwill, desire to build trust and sincere desire to create a positive atmosphere vis a vis the Palestinian Authority (PA), with the goal of bringing our neighbors back to the table of direct negotiations.“

The PA has refused to resume direct negotiations until Israel agrees to impose a construction freeze in the West Bank for the duration of such resumed negotiations - which Israel refuses to do.

Mr Liberman has listed the following “significant gestures” made by Israel to attract the PA to drop its demand for a freeze and return to the negotiating table - which he claims are “not properly represented or reflected in the policy of the European Union or the Quartet on this subject.”

1. Israeli Finance Minister Yuval Shteinitz and PA Prime Minister Salam Fayyad concluded (July 31) arrangements with respect to the transfer of goods between Israel and the PA and related tax procedures as recommended by the International Monetary Fund.
2. In light of the PA‘s budget crisis, Israel transferred at the beginning of the month of Ramadan (July 27) an advance of NIS 180 million (approximately USD 45 million) of August tax remittances. The money was intended to help the PA pay salaries in time to celebrate the holiday.
3. An agreement was concluded (July 14) to employ an additional 5,000 Palestinian construction workers in Israel;
4. The number of roadblocks was reduced to 10, most of which are normally open;
5. The remains of Palestinian terrorists were returned (May 31).
6. Israel agreed to develop the gas field off the Gaza shoreline.
7. Israel is promoting infrastructure projects in Area C, including completion of a master plan. In 2011, 119 infrastructure projects were approved, 58 of them with international financing. Fifteen projects relating to the construction and renovation of infrastructures for schools and clinics have received “fast-track” approval.

Mr Liberman complains that there has been no willingness or positive attitude on the part of the PA to reciprocate these moves - and has pointed to the following actions undertaken in the diplomatic and legal arenas against Israel:

1. Attempts to accelerate illegal construction in Area C of the West Bank where sole responsibility is vested in Israel (including dragging the EU into this problematic activity)
2. Encouraging an economic boycott on the Israeli economy in the West Bank
3. Generating repeated negative statements against Israel.
4. Blaming Israel for the murder of Yassir Arafat
5. Ongoing institutionalized incitement in the Palestinian media, attacking Israel and the legitimacy of the State’s existence.

Mr Liberman has also made a stinging attack on PA President Mahmoud Abbas claiming:

1. Mr. Abbas is apparently uninterested or unable—due to his standing in the domestic Palestinian scene vis a vis Hamas, and in light of the regional geopolitical situation—to reach an agreement which would bring an end to the conflict, including addressing all the core issues.
2. Mr Abbas is creating a culture of blaming Israel for delaying the process, while attempting to achieve advantages without negotiation via blackmailing and ongoing attempts to internationalize the conflict - which he says can be confirmed by the Jordanians.
3. In a calculated manner, Mr. Abbas is focusing his dialogue with the international community on the subject of settlements.

Unfortunately - Mr Liberman further claims - the international community tends to accept this discourse lock, stock and barrel, without criticism or a nuanced approach. This is a damaging attitude, which according to Mr Liberman does not reflect the reality on the ground.

Mr Liberman is at pains to further point out that:

1. The entire area of the settlements constitutes approximately one percent of the area of the West Bank.
2. The last settlement which Israel constructed was in 1991.
3. In the framework of the peace accord with Egypt (1979), Israel evacuated all the settlements and military bases in Sinai.
4. In 2005 - Israel evacuated all of its settlements from the Gaza Strip, as well as four settlements in the northern West Bank - and since such withdrawal 14,000 rockets and missiles have been indiscriminately shot at towns and villages in southern Israel from Gaza.

Mr Liberman makes the following further points in relation to the vexed issue of settlements:

1. Facts and history, as opposed to the simplistic stereotypes and political bias, contradict the idea that somehow the settlement enterprise is the main obstacle to renewing the negotiations. This premise simply does not stand up to the test of reality or the historic precedent of the peace process between Israel and its neighbors. Both peace accords, with Egypt and Jordan, were signed when settlements existed;
2. The claim that settlements are the obstacle to peace is unfounded

Mr Liberman’s prescription for restarting the stalled negotiations calls for fresh general elections for the PA to enable a new, legitimate, hopefully realistic Palestinian leadership to be elected. Such elections were due to be held in 2010 and have since been postponed several times. No new date has been set for such elections.

Israel’s Prime Minister Benjamin Netanyahu and Defence Minister Ehud Barak have since made it very clear that such a proposal does not represent Israel‘s official position. Clearly the European Union could not in such circumstances be expected to endorse Mr Liberman’s proposal as a possible circuit breaker to get negotiations started again.

However - the European Union cannot keep walking the diplomatic tightrope and simply ignore Mr Liberman‘s letter.

Surely the way forward now requires the European Union to indicate whether it considers that the PA should resume negotiations without preconditions in the light of the “significant gestures“ made by Israel.

If the answer is in the affirmative - then the European Union should indicate whether the PA’s refusal to do so would result in the PA being isolated from total or partial diplomatic and financial support from the European Union until the PA resumes such negotiations.

If the answer is in the negative - then the European Union should spell out what it considers needs to be further done by Israel to get the parties around the negotiating table - and whether Israel’s refusal to do so would result in Israel being isolated from total or partial diplomatic and financial support from the European Union until Israel meets the European Union’s requirements

A one line throwaway response from the European Union will not suffice. Baroness Ashton needs to pen a detailed reply to Mr Liberman without delay.

Mr Liberman has put Israel’s cards on the table. Now it is time for the European Union to do likewise.
