Trump Thrashes Clinton On Ending Sexual Violence In Syria And Iraq

[Published 16 October 2016}

Mainstream American media’s obsession with groping allegations against Donald Trump going back twenty years or more has papered over public discussion of major policy differences between Trump and Hillary Clinton on defeating Islamic State and ending the horrific sexual violence perpetrated on women and children in Syria and Iraq for the last two years.

In a stark report to the UN Security Council on 30 September — UN Secretary General Ban ki-Moon warned:
“ISIL [Islamic State] continues to systematically use sexual violence against Yazidi women and girls in Iraq and the Syrian Arab Republic, as well as against other minorities caught up in the conflict. Even though some women have managed to escape their captors, around 3,800 abducted Yazidis were still missing at the time of writing. This is a matter of grave concern. Those who have escaped have described the appalling conditions under which they were bought, sold, traded and abused. Both girls and boys are advertised online and traded for weapons, suicide vests, cars and a range of other commodities. Thus far, no formal mechanisms have been established to secure the release of those held captive by ISIL. Those who have managed to escape have done so with the help of their families and smugglers or by taking advantage of other opportunities. Some have resorted to suicide as their only escape. The children of women who commit suicide, or who attempt to escape, are beaten or killed as punishment”
You have to search high and low to find any American media discussion of these highly disturbing revelations.

America and Russia have become embroiled in these conflicts raging in Syria and Iraq and both bear a major role in ending this ongoing dehumanisation of women and children. Yet American media has not critically examined Trump or Clinton’s views on what each would do under their Presidency to defeat Islamic State and end such reprehensible sexual violence.

Co-operation with Russia to achieve these objectives — as espoused by Trump — has been rejected by Clinton - who promises to follow President Obama’s resolute refusal to co-operate with Russia in defeating Islamic State in Syria since November 2015.

Clinton made her policy crystal clear in the second Presidential debate:
“It’s also important I intend to defeat ISIS, to do so in a coalition with majority Muslim nations.”
Who these Muslim nations are and how Clinton intends to defeat Islamic State in Syria without Russian co-operation remains unexplained. It is a pipedream the American media should be grilling her on every day until they get an answer.

Trump however indicated in the same Presidential debate that he would welcome co-operation rather than confrontation with Russia:
“I don’t know Putin. I think it would be great if we got along with Russia because we could fight ISIS together, as an example.”
Trump and Putin acting in concert or going hand in hand to the Security Council jointly sponsoring a commonly agreed plan of action to eradicate Islamic State represent two possible ways forward.

Meanwhile new allegations of decades-old sexual transgressions by Trump surface in the American media accompanied by sanctimonious expressions of indignation to justify his unfitness to be America’s next President.

Makes for salacious reading — but keeps voters in the dark on whether Trump or Clinton is the best candidate to:
1. See Islamic State defeated

2. End the ongoing sexual violence in Syria and Iraq

3. Extricate America from Obama’s disastrous forays in the Middle East that continue to cause American military casualties and bankrupt America both morally and financially.
Trump may not be perfect but America’s media should hang its head in shame.

Palestine - Security Council And Quartet Silence Dooms Two-State Solution

[Published 6 February 2016]

The UN Security Council and the Quartet — Russia, America, the United Nations and the European Union — have ended any expectations they had of successfully negotiating a two-state solution between Israel and the Palestine Liberation Organisation - after failing to categorically reject UN Secretary-General Ban Ki-moon’s highly offensive remarks before the Security Council and in the New York Times.

Ban told the Security Council on January 26:
“Palestinian frustration is growing under the weight of a half century of occupation and the paralysis of the peace process.

Some have taken me to task for pointing out this indisputable truth.

Yet, as oppressed peoples have demonstrated throughout the ages, it is human nature to react to occupation, which often serves as a potent incubator of hate and extremism.”

Reacting to “occupation” can never justify the murder of Israeli civilians in their own homes, shopping in supermarkets, meeting in bars, or waiting at bus stops.

Such acts of murder are despicable and inhumane — and the Security Council and the Quartet should have said so clearly and unequivocally.

Following Israel’s trenchant criticism of these statements a clearly piqued Ban ran off to the New York Times on 31 January claiming he had been misrepresented:
“Some sought to shoot the messenger — twisting my words into a misguided justification for violence. The stabbings, vehicle rammings and other attacks by Palestinians targeting Israeli civilians are reprehensible. So, too, are the incitement of violence and the glorification of killers.”

Ban had dug himself an even deeper hole.

Failing again to call such stabbings, vehicle rammings and other targeted attacks on Israeli civilians as “murder” - was reprehensible.

The Security Council and the Quartet should have made it absolutely clear that until such murderous acts ceased - the Quartet’s further participation in assisting and facilitating the implementation of the two-state solution envisaged by the Oslo Accords and the Bush Roadmap would be indefinitely suspended.

That role had been specifically assigned to the Quartet in 2003 when the Bush Roadmap was released:
“A two state solution to the Israeli-Palestinian conflict will only be achieved through an end to violence and terrorism when the Palestinian people have a leadership acting decisively against terror and willing and able to build a practicing democracy based on tolerance and liberty, and through Israel’s readiness to do what is necessary for a democratic Palestinian state to be established…

The Quartet will assist and facilitate implementation of the plan ... including direct discussions between the parties as required.”

In July 2015 the Quartet’s role was deliberately changed when:
1. The Quartet’s representative Tony Blair stood down with no replacement whilst his office — the Office of the Quartet Representative (OQR) - was renamed the Office of the Quartet (OQ).

2. The OQ’s stated mandate was:
“to support the Palestinian people on economic development, rule of law and improved movement and access for goods and people, as they build the institutions and economy of a viable and peaceful state in Gaza and the West Bank, including East Jerusalem.”
An independent non-partisan Quartet had overnight been transformed into a biased and hostile Quartet - ignoring Israel’s territorial claims and security needs whilst solely supporting the “Palestinian people”.

No longer were the “democratic Palestinian state” or “practising democracy” mentioned in the Roadmap considered non-negotiable end objectives.

Changing the name had certainly changed the game — with the murder of Israeli civilians and the glorification of their killers beginning soon thereafter.

Whilst the Security Council and Quartet take no decisive action to effectively end these ongoing murders - the two-state solution — and the Quartet’s role - will be doomed to political oblivion.

Palestine - 1922 Two-State Solution Key To Resolving Arab-Jewish Conflict

[Published 22 October 2015]

United Nations Secretary-General Ban-Ki moon has jetted into Jerusalem on a fool’s errand - with tensions continuing to escalate between Arabs and Jews as their conflict spanning almost 100 years remains unresolved.

The Secretary-General observed:
“Beyond the immediate tensions, what is missing is the resolve to restore a political horizon for talks, and a political process that delivers real results and hope… We must, for the future of our children, turn back from this dangerous abyss, safeguard the two-state solution and lead people back onto the road towards peace,”

Safeguarding this “two-state solution” – code words for creating a second Arab State in Mandatory Palestine in addition to Jordan – is a lost cause. Restoring talks on this failed political process after twenty years of fruitless negotiations is meaningless United Nations babble speak.

The Secretary-General needs to focus on the “two-state solution” actually existing in 2015 – Israel and Jordan – the two successor States to the 1922 Mandate for Palestine – which eventually emerged after:
1. the 1920 Arab riots and

2. the political machinations of France and Great Britain between 1920 and 1922.
The riots were intended to pressure decisions affecting the fate of Palestine, Lebanon, Syria and Mesopotamia (Iraq) at the San Remo Conference starting on 19 April 1920 - following the liberation of those territories from 400 years of Ottoman Empire rule in World War 1.

The Arabs opposed a Jewish homeland in Palestine – and went on a murderous rampage to express their rage. 5 Jews and 4 Arabs were killed and hundreds wounded between 4 April and 7 April 1920.

However, the riots had little impact on the decisions taken at San Remo and the subsequent signing of the Treaty of Sevres.

The resulting Mandate for Palestine – adopted unanimously by all 51 member States of the League of Nations on 24 July 1922:
1. Gave recognition to the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country

2. Empowered Great Britain as the Mandatory Power to be responsible for placing the country under such political, administrative and economic conditions as would secure the establishment of the Jewish national home whilst safeguarding the civil and religious rights of existing non-Jewish communities in Palestine and the rights and political status enjoyed by Jews in any other country.
The Mandate, however, contained Article 25 – a provision used to deny the Jews the right to reconstitute the Jewish National Home in Transjordan - 78% of the territory of Mandatory Palestine.

The inclusion of Article 25 followed French pressure on the British to stop Abdullah – the second son of the Sharif and Emir of Mecca Hussein bin Ali – leaving Transjordan whilst en route to Damascus with an armed force of 400 Arabs to help his brother Feisal resist French attempts to remove him from power in Syria.

Britain obliged by appointing Abdullah Emir of Transjordan on 11 April 1921. This Emirate became the independent Jew-free Hashemite Kingdom of Transjordan in 1946 – today’s Jordan.

Achieving these British and French objectives closed the door firmly on any right to reconstitute the Jewish National Home in Transjordan - confining that right within the remaining 22% of Mandatory Palestine – today’s Israel, the West Bank (Judea and Samaria) and Gaza.

Redrawing the current boundaries of that fateful 1922 decision - taking into consideration today’s changed circumstances on the ground - remains the key to ending the Arab-Jewish conflict.

Pencils and rubbers wielded by Israeli and Jordanian negotiators can end the indiscriminate murder and maiming of Jews by Arab gun-toters, knife-stabbers, stone-throwers and car-rammers - and the inevitable Jewish response.

Palestine - European Union Causes Peace Process And Quartet Meltdown

[Published 16 February 2015]

Revelations that the European Union (EU) has been acting illegally in funding and facilitating the construction of more than 400 unauthorised buildings in areas in the West Bank (Judea and Samaria) under exclusive Israeli control — signals the end of:
1. negotiations between Israel and the Palestine Liberation Organisation under the 1993 Oslo Accords and the 2003 Bush Roadmap and

2. the role of the Quartet - America, Russia, the United Nations and the European Union - as mediator in those negotiations
The Daily Mail - in exposing the EU’s bizarre behaviour - reported on 6 February that:
“Official EU documentation reveals that the building project is intended to ‘pave the way for development and more authority of the PA over Area C (the Israeli area)’, which some experts say is an attempt to unilaterally affect facts on the ground. Locally, the villages are known as the ‘EU Settlements’, and can be found in 17 locations around the West Bank. They proudly fly the EU flag, and display hundreds of EU stickers and signs. Some also bear the logos of Oxfam and other NGOs, which have assisted in the projects.”
The EU through its spokesman- Shadi Othman - attempted to justify such conduct by reiterating the EU’s unilateral opinion as to the final outcome of the currently stalled negotiations:

“We support the Palestinian presence in Area C. Palestinian presence should not be limited Areas A and B. Area C is part of the occupied Palestinian territory which eventually will be Palestinian land.”

Why Israel’s approval was not first sought before the EU surreptitiously undertook such activity - remains unexplained.

Representatives of the Quartet — Russian Foreign Minister Sergey Lavrov , United States Secretary of State John Kerry, European Union High Representative for Common Foreign and Security Policy Federica Mogherini and UN Deputy Secretary General Jan Eliasson (representing UN Secretary General Ban Ki-Moon) - met in Munich on February 8 — two days after the European Union’s illegal actions were exposed - but no mention was made of the EU’s devious conduct nor was there any call for it to be immediately halted.

The remaining three Quartet members have - by their silence - clearly signalled they condone such illegal conduct by the EU and support its continuation.

Hypocritically - the Quartet Representatives declared:
“Pending the resumption of negotiations, the Quartet called on both parties to refrain from actions that undermine trust or prejudge final status issues.”

It is hard to conceive any action more likely to undermine trust or prejudge final status issues than the Quartet’s failure to condemn the EU’s own aberrant behaviour and call for an immediate halt to its illegal activities in the West Bank.

The Quartet Representatives repeated their mantra:
“A sustainable peace requires the Palestinians’ aspirations for statehood and sovereignty and those of Israelis for security to be fulfilled through negotiations based on the two-state solution.”

The parameters under which those negotiations were being held between Israel and the PLO have now been well and truly consigned to the dustbin of history as a result of the EU’s disgraceful conduct — joining so many other failed proposals made since 1920 aimed at ending the Jewish-Arab conflict.

The Quartet has been found sadly wanting and is clearly out of tune - abandoning any sense of impartiality or propriety in aligning itself with one party to the dispute.

Israel’s Prime Minister - Benjamin Netanyahu - has now directed that action be commenced to demolish these illegal EU structures.

The Quartet has been totally compromised - the peace process and its intricate negotiating structure irretrievably ended.

Back to the drawing board for yet another new proposal…...

Eradicating Ebola Outbreak And Islamic State Scourge Require Same Prescription

[Published 12 October 2014]

Ebola has now claimed over 4000 lives mainly in Liberia, Nigeria, Sierra Leone and Guinea.

The United Nations Security Council response to eradicating this deadly virus and prevent it spreading world-wide stands in marked contrast to its ineffectual resolutions seeking to address the catastrophic humanitarian crisis that has emerged in Syria and Iraq over the past five months.

A flurry of diplomatic activity to halt the Ebola outbreak resulted in Security Council Resolution 2177 being passed on 18 September calling on:
“Member States to provide urgent resources and assistance, including deployable medical capabilities such as field hospitals with qualified and sufficient expertise, staff and supplies, laboratory services, logistical, transport and construction support capabilities, airlift and other aviation support and aeromedical services and dedicated clinical services in Ebola Treatment Units and isolation units, to support the affected countries in intensifying preventive and response activities and strengthening national capacities in response to the Ebola outbreak and to allot adequate capacity to prevent future outbreaks;”

On 29 September the UN Mission for Ebola Emergency Response (UNMEER) was established in Ghana — whose Minister for Communications expressed the Government of Ghana’s profound support to the United Nations.
“Ebola is a global problem that knows no boundaries. Ghana is happy to host the UNMEER as we work together to contain and prevent further spread of the disease”

On 10 October UN Secretary General Ban Ki-moon made the following remarks at a special meeting focusing on the Ebola virus held at the World Bank in Washington, D.C:
“The best antidote to fear is an effective and urgent response. We need a 20-fold resource mobilization,” Mr. Ban told those gathered, as he called for more mobile laboratories, vehicles, helicopters, protective equipment, trained medical personnel and medevac capacities to be provided in order to stay Ebola’s advance.”

The World Health Agency has reportedly noted that:
“375 health care workers are known to have developed Ebola (67 in Guinea, 184 in Liberia, 11 in Nigeria, and 113 in Sierra Leone), and 211 of them have died as a result (35 in Guinea, 89 in Liberia, five in Nigeria, and 82 in Sierra Leone).”

The lives of many more health care workers and those fighting the Ebola virus seem destined to be increased before its threat is eradicated.

The Security Council’s pathetic response to the Islamic State scourge pales by comparison.

The Islamic State — since its declaration in June - has spread its tentacles in occupying more territory, engaged in evil and barbaric beheadings designed to engender fear, committed carnage and caused intolerable suffering for those being increasingly caught up in its horrific path.

Security Council Resolution 2170 passed on 15 August 2014 highlighted the danger of the threat to world peace and security posed by Islamic State - but did precious little to halt its spread:
“deploring and condemning in the strongest terms the terrorist acts of ISIL and its violent extremist ideology, and its continued gross, systematic and widespread abuses of human rights and violations of international humanitarian law;

“strongly condemning the indiscriminate killing and deliberate targeting of civilians, numerous atrocities, mass executions and extrajudicial killings, including of soldiers, persecution of individuals and entire communities on the basis of their religion or belief, kidnapping of civilians, forced displacement of members of minority groups, killing and maiming of children, recruitment and use of children, rape and other forms of sexual violence, arbitrary detention, attacks on schools and hospitals, destruction of cultural and religious sites and obstructing the exercise of economic, social and cultural rights, including the right to education…

“demanding that ISIL, ANF and all other individuals, groups, undertakings and entities associated with Al-Qaida cease all violence and terrorist acts, and disarm and disband with immediate effect;”

Surprise, surprise - six weeks later the Secretary General reported that:
"...more than 13,000 foreign terrorist fighters from more than 80 Member States of the UN had joined ISIL and the Al-Nusra Front as a consequence of the conflict in Syria - citing the estimate of the United Nations Al-Qaeda-Taliban Monitoring Team.

Such terrorism must be defeated, but in a way that avoided further radicalization and civilian deaths. That should be done through a multilateral, multifaceted strategy beyond the immediate security approach. “Over the long term, the biggest threat to terrorists in not the power of missiles — it is the politics of inclusion,” he said.

Ban Ki-moon’s limp wristed conclusions have seen yet another inconsequential Security Council Chapter VII Resolution 2178 passed on 24 September — calling on member states to prevent the flow of money, resources and fighters into Syria and Iraq to bolster Islamic State.

This Resolution completely overlooks those civilians and fighters in other terrorist groups already living in Syria and Iraq defecting or joining the Islamic State juggernaut.

Aerial bombardment of Islamic State forces by America and its coalition allies - without the authority of a Security Council Resolution backed by America and Russia — coupled with vainly attempting to stem the flow of fighters flocking to Islamic State - can only disrupt but never degrade and destroy Islamic State.

Ending the Islamic State rampage requires the Security Council to prescribe the same medicine thought essential for eradicating the Ebola virus — a seasoned, well-armed and supplied United Nations fighting force to comprehensively defeat and eliminate Islamic State.

The sooner the Security Council so acts — the sooner this blight on humanity will be contained and ultimately eradicated.

Syria - Security Council International Conference Pure Pipe-Dream

[Published 6 October 2013]

It seems incredible that after 17 months of wrangling the best the Security Council could agree on is calling another International Conference that has no possible chance of convening - let alone helping peacefully resolve an end to the 30 months old conflict in Syria.

Suspended in an apparent time warp - Resolution 2118 - passed on 27 September - calls for:
“the convening, as soon as possible, of an international conference on Syria to implement the Geneva Communiqué, and calls upon all Syrian parties to engage seriously and constructively at the Geneva Conference on Syria, and underscores that they should be fully representative of the Syrian people and committed to the implementation of the Geneva Communiqué and to the achievement of stability and reconciliation;"

The Security Council seems to have not noticed that since the Geneva Communique was issued on 30 June 2012 - the then civil war being waged by Syrians against an autocratic Assad regime has now escalated into a far wider conflict involving foreign jihadist forces seeking to exercise power and influence in this latest episode of the Arab Spring.

Indeed on 25 September - just two days prior to the passing of Resolution 2118 - the Washington Post had reported:”
“Nearly a dozen of Syria’s powerful rebel factions, including one linked to al-Qaida, formally broke with the main opposition group in exile Wednesday and called for Islamic law in the country, dealing a severe blow to the Western-backed coalition.

The new alliance is a potential turning point, entrenching the schism within the rebellion and giving President Bashar Assad fuel for his long-stated contention that his regime is battling Islamic extremists in the civil war

The Turkey-based Syrian National Coalition — the political arm of the Free Syrian Army rebel group — has long been accused by those fighting inside Syria of being a puppet promoted by the West and Gulf Arab states supporting the Syrian rebellion.

Wednesday’s public rejection of the coalition’s authority will likely be extremely damaging for its future in Syria, particularly at a time when the U.S. and Russia are pushing for peace talks.”

It should be blindingly obvious that this development signals that some of the forces within the so-called Free Syrian Army are breaking up with the Syrian National Coalition supported by eleven West and Arab states - known as the London Eleven - to join forces with more hard-line foreign anti-Western Islamists.

Now just a few days later - Yahoo News has ominously reported on 2 October:
“The al Qaeda-linked Islamic State of Iraq and the Levant (ISIL) took control of the northern border town of Azaz last month, kicking out rival rebels and prompting Turkey to shut the crossing about 5 km (3 miles) away.

ISIL, which wants to merge Syria into a larger state ruled by Islamic law, has maintained control of the town since then and clashes have periodically erupted between it and fighters of the Northern Storm brigade that they had expelled to its outskirts.

Activists said the latest fighting broke out on Tuesday night after a deadline ISIL had set for Northern Storm fighters to surrender their weapons came to an end…

... The Syrian rebels have been undermined by infighting, partially over conflicting ideology, but more often over territory, spoils of war and control of resources and smuggling.”

United Nations Secretary-General Ban Ki-moon showed how out of touch he is with what is happening in Syria.

In the full proces-verbal of the Security Council’s discussion after the adoption of resolution 2118 - the Secretary General:
“pressed the Council to capitalize on its new-found unity by focusing on two other equally crucial dimensions of the conflict: the dire humanitarian situation and the political crisis. For their parts, the Syrian sides must engage constructively towards the creation of a democratic State, while regional actors must challenge those who sought to undermine that process.”

Any hope for a democratic state ever arising from the current chaos, carnage and confusion in Syria is beyond comprehension.

The idea that “regional actors” can challenge those against creating a democratic Syria - short of war - is breathtaking.

Sergey Lavrov - Minister for Foreign Affairs of the Russian Federation - said:
"The resolution set up a framework for the political settlement of the conflict by backing the convening of an international conference, which he believed could take place as early as mid-November. He also expected the Syrian opposition to state its readiness.”

As Assad’s prime backer - Russia has obviously relished further embarrassing the London Eleven as they slowly sink in the political quicksand of their own making.

Laurent Fabius - Minister for Foreign Affairs of France - said France:
“felt it was necessary to prepare the Geneva II conference within the framework of the Geneva Communiqué. He had chaired a meeting on Thursday with the President of the Syrian National Coalition, who confirmed a readiness to send a delegation as soon as possible. The Syrian regime’s supporters must make a similar commitment. He urged the Secretary-General and his Special Envoy to move quickly in that direction.”

Strangely the new alliance of Syrian and foreign jihadists did not rate a mention by either Lavrov or Fabius.

They surely know this alliance would spurn any invitation to an international conference - let alone agree to the creation of a democratic State in Syria.

The Security Council is surely living in a fool’s paradise of self delusion and unreality.

Syrian Free Army Signing Own Death Warrant

[Published 15 September 2013]

The swift agreement between Russia and America to collect and destroy Syria’s chemical weapons has been an impressive diplomatic achievement - marred only by the fact that it has taken three weeks longer to reach this point because of their joint failure to focus on ending the use of chemical weapons in Syria - rather than focusing on who was responsible for the atrocity that caused the deaths of 1429 Syrians on 21 August.

Speculation is rife that Syria may have spirited away some part of its chemical weapons arsenal to Iraq and Lebanon in those lost crucial three weeks. Hopefully further joint action by America and Russia in conjunction with UN inspectors can establish the truth or otherwise of this claim.

Equally impressive is the news is that Syria has met its obligations in applying for membership in the Organisation for the Prohibition of Chemical Weapons (OPCW) - as advised by UN spokesperson Martin Nesirky.
“The secretary-general, in his capacity of the depositary of the 1992 Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, has received the formal instrument of accession to the convention by the Syrian Arab Republic… The convention will enter into force for the Syrian Arab Republic on the 30th day following the date of deposit of this instrument of accession, namely on October 14 2013.”

Remarkably - the rebel forces fighting the Assad regime for the last 30 months seem to have set the stage for their demise - by indicating they will not accept the terms of the agreement reached between America and Russia - that should be translated into a binding Security Council Resolution within the next seven days calling for the collection and destruction of all chemical weapons in Syria.

The Kuwaiti News Agency has reported:
"The flagship accord was also applauded by several nations including Arab states namely Egypt and Algeria, but in Istanbul, the Syrian Free Army commander Major-General Saleem Idrees rejected the US-Russian agreement, saying it “will not solve the crisis” in Syria.” He added that the opposition Syrian Free Army would not implement any part of the accord.

“Me and my brother fighters will continue fighting until the removal of the regime. We can’t approve” this agreement, he said and criticized the deal which did not mention a single word on Al-Assad.”

This report - if accurate - could well signal the end of armaments supplies, funding and promised diplomatic support from America and the West for the Syrian Free Army.

It is clear that Russia has fairly and squarely attached the blame for the 21 August atrocity on the rebels - whilst America has been blaming the Assad regime.

Now America and Russia have procured Syria to come to the party and agree to destroy its chemical weapons - the suspicion must still exist - certainly according to Russia - that the rebels are also still in possession of such weapons.

Refusing to surrender any chemical weapons the Syrian Free Army has - or in case of denying it has any such weapons then allowing UN inspectors to verify this fact - will lead to the swift withdrawal of some of the the lifelines that has given the Syrian Free Army the ability to wage the civil war for the last 30 months.

In a roundup of statements supporting the historic agreement reached between America and Russia - the Kuwaiti news agency reported:
“The use of chemical weapons anywhere in the world is an affront to human dignity and a threat to the security of people everywhere,” the President (Obama) said. “We have a duty to preserve a world free from the fear of chemical weapons for our children. Today marks an important step toward achieving this goal.” UN Secretary General Ban Ki-moon welcomed understanding reached by Lavrov and Kerry regarding the safeguarding and destruction of Syria’s chemical weapons stockpiles. “The Secretary General looks forward to learning more of this framework agreement and pledges the support of the United Nations in its implementation,” a UN statement said.

The agreement was applauded by NATO Secretary General Anders Fogh Rasmussen. “This is an important step towards the goal of ensuring the swift, secure and verifiable elimination of Syria’s stocks of chemical weapons. Full and unreserved Syrian compliance is now key,” he said in a statement tonight.

He stressed that the international community has a responsibility to make sure that the long-standing norm and practice against the use of chemical weapons is maintained, and violators are held accountable.”

It is inconceivable that the Syrian Free Army will be able to escape full compliance with the obligation to surrender all chemical weapons in its possession without paying a heavy price politically for continuing support in its civil war against the Assad regime.

America and Russia must now both remain focused on collecting and destroying all chemical weapons in Syria - in whoever’s possession they happen to be.

Continuing failure by the Syrian Free Army to co-operate in achieving this objective could lead to a swift collapse of the uprising and leave Assad in charge - vindicating the political support given to him unswervingly by Russia, China and Iran.

This may be an unpalatable result for the West to swallow - but it’s inevitability now seems to be well on the cards.

In failing to co-operate with the America-Russia initiative - the Syrian Free Army may well be signing its own death warrant.

Syria - Obama And Kerry Converted On Road To Damascus

[Published 10 September 2013]

The swiftness with which attention is now being focused on collecting and destroying chemical weapons located in Syria has been truly breathtaking.

Last Friday 6 September - President Obama was waving a joint declaration signed by Australia, Canada, France, Italy, Japan, Republic of Korea, Saudi Arabia, Spain, Turkey, the United Kingdom and the United States of America at the G20 Summit in St Petersburg - in which there was not one mention of the need to collect and destroy those chemical weapons.

That same day President Obama in his press conference in St Petersburg had been dismissive of a similar proposal suggested in the Congress - after it was specifically drawn to his attention by a reporter.

Yet on Monday 9 September - US Secretary of State John Kerry - when asked in London if there was anything Syrian President Assad could do to avert a US military strike - replied:
“Sure. He could turn over every single bit of his chemical weapons to the international community in the next week. Turn it over, all of it, without delay, and allow a full and total accounting for that”

Kerry seemed to shoot down his own idea - adding immediately:
“But he isn’t about to do it, and it can’t be done, obviously.”

Kerry was made to look rather stupid when Russia’s Foreign Minister - Sergei Lavrov just hours later proposed the idea to Syria:
“We have given our proposal to Syria’s Foreign Minister Walid al-Moallem and are counting on a fast and, I hope, positive response,”

Al-Moallem’s response was short and to the point:
“I carefully listened to Sergei Lavrov’s statement about it. In connection with this, I note that Syria welcomes the Russian initiative based on the Syrian leadership’s concern about the lives of our nationals and the security of our country. We also hail the wisdom of the Russian leadership which is trying to prevent an American aggression against our people.”

German Chancellor Angela Merkel and British Prime Minister David Cameron were quick to jump on the bandwagon and spoke positively of the proposal.

Merkel said:
“Today there were very interesting proposals about the chemical weapons. If this is intended to lead to action and not to just play for time, then Germany will push hard for this path to be further pursued.”

Cameron - who only three days earlier had remained supportive of US President Barack Obama and his plan to embark on military intervention in Syria despite failing to get his own motion through government - was instantly converted to this proposal:
“If that were to be the case it would be hugely welcome. If Syria were to put its chemical weapons beyond use, under international supervision, clearly that would be a big step forward and should be encouraged.”

Even UN General Secretary Ban Ki-moon - who had stood by watching the United Nations Security Council being paralysed as it struggled to get a resolution passed on the atrocity caused by the use of chemical weapons in Syria on 21 August - told reporters on Monday:
“I am considering urging the Security Council to demand the immediate transfer of Syria’s chemical weapons and chemical precursor stocks to places inside Syria where they can be safely stored and destroyed.”

It seems inconceivable that all of the above players, their advisors and Foreign Offices could have allowed the chemical weapons crisis to spiral seriously out of control to the point where a military attack on Syria was the only option being considered.

But the most amazing conversion of all was that of President Obama himself.

Asked by Diane Sawyer of ABC News if he would put plans for an attack on pause should Assad yield control of his chemical weapons - Obama answered:
“Absolutely, if in fact that happened… Let’s see if we can come up with language that avoids a strike but accomplishes our key goals to make sure that these chemical weapons are not used”

Hopefully President Obama has since been on the phone to President Putin to knot out a resolution that can go to the Security Council for approval within the next 24 hours and allow the process of collecting and destroying all chemical weapons in Syria to take place without further delay.

There will no doubt be those who will question whether all such chemical weapons can be collected from both the Assad regime and the rebels.

One needs to wait and see.

Those weapons collected and destroyed under UN supervision will show Assad and the rebels that the world means business - and that any attempt to subvert the Security Council’s resolve will be met with an immediate response.

In a shameful self serving statement - President Obama is seeking to claim the credit for his amazing conversion from advocating and planning a military assault on Syria to securing agreement with Russia on collecting and destroying all chemical weapons in Syria - telling Diane Sawyer:
“I don’t think we would have gotten to this point unless we had maintained a credible possibility for a military strike and I don’t think now is the time for us to let up on that”

Had President Obama addressed the issue of collecting and destroying those chemical weapons rather that trying to blame Assad for having fired them - the process of destruction would already have been well underway.

Obama and Kerry’s judgment has been seriously compromised.

Their conversion to sanity and reality is to be welcomed.

Jordan/West Bank Bi-National State Under Discussion

Israeli and Palestinian negotiators have been discussing the creation of a bi-national State in the West Bank and Jordan according to Professor Richard Falk - United Nations Special Rapporteur on the situation of human rights in the Palestinian Territories occupied since 1967.

Professor Falk is revered by the Palestinians whilst simultaneously being targeted by many others - including United Nations Secretary General Ban Ki-moon and United Nations High Commissioner for Human Rights Navi Pillay - for his controversial views on a range of matters including his suggestion that the Boston marathon bombing was a justifiable response to America’s interventionist US foreign policy and his posting of an anti-Semitic cartoon on his web site.

Writing in his blog “Citizen Pilgrimage” - Professor Falk disclosed discussions were taking place on a bi-national State during an exchange he and I were having - after he had written:
“I do agree with you about the ‘two state’ solution being a dead letter, and rather bad faith on all sides to pretend otherwise.

The question seems to me to be “What Next?” I think the Jordanian option is one answer, but not one I endorse. There is a need for this discussion, I agree to this extent.”

I then sent Professor Falk a recent article written by me arguing for the creation of a bi-national state in Jordan and the West Bank to embrace the aspirations of the Arab populations of both territories.

Professor Falk’s response on 8 July was unexpected and very encouraging:
“I have read your article with care, and it does provide a clear alternative to the two-state solution. It is also an approach that I know from my diplomatic contacts is being encouraged by Israeli negotiators in private meetings with the Palestinian Authority, and toward which the PA has not expressed outright rejection, but apparently a willingness to consider.”

Whilst expressing that he had several problems with this solution - which he enumerated - Professor Falk continued:
“Given the paucity of decent alternatives, if the legitimate representatives of the Palestinian people genuinely accepted such a solution without it being imposed, it might be better than nothing, and the best among bad options.”

I addressed Professor Falk’s concerns to which he made the following response:
“Without attempting to respond point by point because there are some underlying gaps separating our positions that cannot be bridged by reasoning or compromise, I will merely express my reservations about advocating a resumption of negotiations”

Two of Professor Falk’s reservations were:
1. “I do not discern any support among Palestinians for the Jordan bi-national option that you are proposing"

This was a surprising statement in view of the fact that he had earlier indicated that Palestinian negotiators had expressed a willingness to consider such a proposal and were in fact negotiating with Israeli negotiators on such a proposal.
2. "I find no interest in this approach among Jordanians, either those in government or those in leadership roles among the various ethnicities living in the country.”

Professor Falk was apparently unaware that the following statement had been recently made by Jordan’s Minister of Culture - Barakat Awajan:
“Jordan and Palestine are joined by one culture and connected by blood, geography and sacred ties”
My attempt to respond to Professor Falk has been met by an impenetrable fire wall. Three efforts to contact him using three different computers have not been successful. That is unfortunate.

Professor Falk is obviously well placed to know what is going on among the Palestinians.

I would regard his comments on discussions for a bi-national State being conducted between Israeli and Palestinian negotiators as well-sourced and authentic.

Jordanian knowledge and acquiescence in those negotiations can be gleaned from the above statement by Jordan’s Minister of Culture - which incidentally was made face to face to his Palestinian counterpart Anwar Abu Aisha in Amman.

US Secretary of State Kerry has not been travelling backwards and forwards between America and the Middle East merely to have his prestige and reputation trashed in a repeat of what has occurred to previous Secretaries of State over the past 20 years.

Creating a bi-national State in Jordan has always been the solution most likely to succeed in resolving the conflict between Jews and Arabs.

It is a solution which accords with the historic, geographic and demographic realities of the region and will result in the Jews ending up with sovereignty in about 20% of Mandate Palestine and the Arabs with sovereignty in about the remaining 80%.

There will be many Jews and Arabs not happy with an outcome that does not yield them 100% and the other nothing.

That however is not what a settlement is about. A good settlement is one which leaves both sides bemoaning what they have gained.

Professor Falk’s opinion that the bi-national state is the best of many bad options will surely resonate with the Palestinians. He has their confidence and their ear. I hope he is instrumental in helping them understand the wisdom of accepting such a resolution - if further conflict and suffering is to be avoided.

Maybe indeed we might at last just be seeing some light at the end of the tunnel after travelling for more than 95 years in the darkness - witnessing conflict after conflict with intolerable suffering for both Jews and Arabs.

After all - the right to breathe is the most fundamental human right we all have.

Palestine - UN Special Rapporteur Bans Free Speech

[Published 31 March 2013]

United Nations Special Rapporteur on “the situation of human rights in the Palestinian territories occupied since 1967” - Professor Richard Falk - has taken the extraordinary action to ban posts on his blog page “Citizen Pilgrimage”.

This has happened to myself and at least one other person when we attempted to post comments in response to an article written by Professor Falk titled ” What was wrong with Obama’s speech in Jerusalem”

My detailed comment sought to point out what was right with President Obama’s speech in Jerusalem. It had been published as an article on many Internet pages around the world and reproduced on the web sites of scores of others without editorial amendment.

I presented a considered and reasoned analysis of what President Obama had said. It was not couched in inflammatory or defamatory terms. It considered aspects of President Obama’s speech not referred to in Professor Falk’s article and came to an entirely different conclusion to the views expressed by Professor Falk.

To my amazement Professor Falk’s response to my post was:
“My blog is no longer open for this sort of polemics on the Israel/Palestine conflict. There are many other more important venues to carry on these discussions.”

My reply to Professor Falk - pointing out his decision amounted to the banning of free speech and requesting he reconsider his decision - went unanswered.

I subsequently sought to post an entirely different response to another contributor’s comment - but it was also not published.

One person who sought to post a comment to Professor Falk’s article received the following response:
“Mr. Skolnik: My blog is no longer open for this sort of polemical responses that insult either me or others who submit comments. There are many other venues for this sort of debate.”

Stangely Professor Falk had no similar qualms in publishing the following comment from one of his readers:
“I have been following events in Israel and Cyprus closely, and stand by my assertions. I find it both fascinating and terrifying that Germany is the force behind the Cypriot haircut, in which unscrupulous jewish industrialists, all of whom hold Israeli passports, are having their bank accounts seized and money transferred to Germany. Who would have predicted this turn of events, but really, once you spot the pattern, it becomes impossible to deny this jaw-dropping turn of events, and its ominous implications.”

It is clear that there are many readers of Professor Falk’s blog who would be grossly offended by this Jew-hating language - yet it was published.

I do not seek to silence these Jew-haters airing their views on Professor Falk’s blog. Better the world should be aware such views exist and are exposed to critical comment.

My articles sometimes attract such vile and repulsive comments. Never would I seek to have them expunged. I prefer to respond to such comments or let my readers do so.

But why should a UN Rapporteur concerned with human rights seek to ban the views of others like myself and Mr Skolnik - if he allows such a vile post as this to appear as a comment on the same blog page?

Intrigued by the Professor’s totally unexpected and unexplained reaction to my post - I contacted other sites where his article had been published.

One was a virulently Jew-hating web site called “Shoah - The Palestinian Holocaust” It had no problem posting the identical response that I attempted to post on Professor Falk’s web page

Another was “Ramy Abdeljabbar’s Palestine and World News” - not what one would call a pro-Israel site. It published my response to Professor Falk’s article without indulging in the histrionics and petulance displayed by Professor Falk.

A third site was “Transcend Media Service” - which describes itself in the following terms:
“TRANSCEND International is an experiment in promoting peace by peaceful means throughout the world. Traditionally, institutes have been centered around a building where the people who work together meet on a regular basis. Since many people who share common interests in helping transform conflicts nonviolently and creatively are geographically scattered and cannot usually be physically together, our solution is to create an electronic network of members. This, in addition, diminishes our carbon footprints and contributes to attenuate the global warming crisis.”

Professor Falk is a member of the Transcend Network.

Transcend saw nothing objectionable in posting my response to Professor Falk’s article

Professor Falk needs to understand that attempts by him to ban freedom of expression and free speech on his web site demean himself and his position as a UN Special Rapporteur.

Those in authority at the UN who repeatedly express their support for the protection of human rights must be prepared to act against one of their own by denouncing Professor Falk’s actions in the strongest terms with a view to ending his crass attempt to deny the inalienable right of every human being to speak out and be heard.

Secretary General Ban Ki-moon and members of the UN Human Rights Council - are you listening or do you endorse Professor Falk’s outrageous conduct?

Palestine - UN Farce Promises Theatre Of The Absurd

[Published 26 September 2011]

The appearance of Mahmoud Abbas at the podium of the United Nations General Assembly on 23 September was reportedly met with “rapturous applause” by those present to witness this latest farce in the ongoing efforts to create a new Arab State between Israel and Jordan for the first time ever in recorded history.

UN Secretary General Ban KI - moon was presented with a letter signed by Mr Abbas as “President of the State of Palestine, Chairman of the Executive Committee of the Palestine Liberation Organization“.

Mr Abbas’s letter stated that he had:
“the profound honor, on behalf of the Palestinian people to submit this application of the State of Palestine for admission to membership in the United Nations.”

He continued:
“This application for membership is being submitted on the Palestinian people’s natural, legal and historic rights and based on United Nations General Assembly resolution 181 (II) of 29 November 1947 as well as the Declaration of Independence of the State of Palestine of 15 November 1988 and the acknowledgement by the General Assembly of this declaration in resolution 43/177 of 15 December 1988.

“In this connection, the state of Palestine affirms its commitment to the achievement of a just, lasting and comprehensive resolution of the Israeli-Palestinian conflict based on the vision of two states living side by side in peace and security, as endorsed by the United Nations Security Council and General Assembly and the international community as a whole and based on international law and all relevant United Nations resolutions.”

Those joining in the rapturous applause should now digest what Mr Abbas is asking for - and reflect on his standing to do so.

When they do - the application should be rejected by both the Security Council and the General Assembly for the following reasons:
1. Mr Abbas falsely continues to use the title “President of Palestine” although his term of office expired on 1 January 2010 pursuant to Article 36 of the Basic Law 2003 (as amended).
2. The application does not identify the territorial boundaries of Palestine and thus would preclude any action by the UN against such a member - should the provisions of the UN Charter be breached by it in the future.
3. No State can be admitted as a member of the UN that fails to comply with the preconditions necessary for the declaration of Statehood pursuant to the Montevideo Convention 1933. The Declaration of Independence of the State of Palestine on 15 November 1988 is similarly deficient.
4. Basing the application on UN General Assembly Resolution 181(11) of 29 November 1947 is meaningless since this Resolution was rejected in 1947 and has become extant. General Assembly resolutions in any event are not binding in international law.
5. As Chairman of the Palestine Liberation Organization (PLO) - Mr Abbas is committed to maintaining the territorial indivisibility of Israel, Gaza, the West Bank and Jordan under Article 2 of the PLO Charter. The current application contains no mention of his intention to revoke this provision in the Charter or to forgo any claims to any other parts of this territory from either Israel or Jordan.
6. Claiming that the application is based on international law and all relevant UN resolutions is contradicted by the fact that the PLO considers all such law null and void under article 20 of the PLO Charter which states:
“The Balfour Declaration, the Mandate for Palestine, and everything that has been based upon them, are deemed null and void.“
No commitment has been made by Chairman Abbas to revoke this provision of the PLO Charter as a condition of the UN approving his application for membership.
7. The PLO is no longer the sole spokesman for the Palestinian Arabs and Mr Abbas is deceiving the UN in claiming to be speaking:
“on behalf of the Palestinian people”

An unconstitutional President claiming to be the sole spokesman for the Palestinian Arabs when he clearly is not - as his unresolved power struggle with Hamas shows - applying for membership of the United Nations for a country within undefined boundaries that is not controlled by the PLO whilst claiming to respect and observe international law when the opposite is demonstrably evident - is indeed the theater of the absurd into which the UN finds itself being propelled once again..

Israel’s Prime Minister - Benjamin Netanyahu - followed Mr Abbas to the podium and was quick to point out how automatic majorities at the UN had been used to incite institutionalized hatred against Israel.
“After all, it was here in 1975 that the age-old yearning of my people to restore our national life in our ancient biblical homeland—it was then that this was braided—branded, rather — shamefully, as racism. And it was here in 1980, right here, that the historic peace agreement between Israel and Egypt wasn’t praised; it was denounced! And it’s here year after year that Israel is unjustly singled out for condemnation. It’s singled out for condemnation more often than all the nations of the world combined. Twenty-one out of the 27 General Assembly resolutions condemn Israel—the one true democracy in the Middle East.

Well, this is an unfortunate part of the UN institution. It’s the—the theater of the absurd. It doesn’t only cast Israel as the villain; it often casts real villains in leading roles: Gadhafi’s Libya chaired the UN Commission on Human Rights; Saddam’s Iraq headed the UN Committee on Disarmament.

You might say: That’s the past. Well, here’s what’s happening now—right now, today. Hezbollah-controlled Lebanon now presides over the UN Security Council. This means, in effect, that a terror organization presides over the body entrusted with guaranteeing the world’s security.

You couldn’t make this thing up.

So here in the UN, automatic majorities can decide anything. They can decide that the sun sets in the west or rises in the west. I think the first has already been pre-ordained. But they can also decide—they have decided that the Western Wall in Jerusalem, Judaism’s holiest place, is occupied Palestinian territory.
”

The theater of the absurd is definitely set to swing into action once again at the UN over the next few weeks. As it does so - the authority and standing of the UN is set to sink into further disrepute.

Palestine - Quartet Misses The Beat

[Published 15 July 2011]

The utter futility inherent in pursuing the two- state solution - the creation of a 22nd Arab State between Israel and Jordan - was brought home this week when the most powerful negotiating team ever assembled in history - the Quartet - was unable to come up with a jointly acceptable statement to persuade Israel and the Palestinian Authority (PA) to resume direct negotiations.

The Quartet comprises America, Russia, the European Union and the United Nations.

The two day meeting of the Quartet in Washington was attended by US Secretary of State Hilary Clinton, Russian Foreign Minister Sergey Lavrov, EU Foreign Minister Catherine Ashton, UN Secretary-General Ban Ki-Moon, and Quartet special envoy to the Middle East Tony Blair.

The player out of tune was apparently Sergev Lavrov,

He reportedly prevented the Quartet from issuing a demand that the PA acknowledge Israel as the Jewish State as the basis for negotiations in exchange for Israel’s acceptance of the 1949 Armistice lines. He also reportedly refused to refrain from raising the proposed PA statehood bid at the UN in September.

It is this kind of pussyfooting around that encourages the PA to maintain its rejectionist stance.

Israel is the Jewish State referred to in the United Nations 1947 Partition Plan which provided:
“Independent Arab and Jewish States and the Special International Regime for the City of Jerusalem, set forth in Part III of this Plan, shall come into existence in Palestine two months after the evacuation of the armed forces of the mandatory Power has been completed but in any case not later than 1 October 1948. The boundaries of the Arab State, the Jewish State, and the City of Jerusalem shall be as described in Parts II and III below.”

The Soviet Union voted in favor of this resolution. Russia has already seen more than one million Russian Jews of Jewish origin emigrate from Russia to Israel in the 1980’s and 1990’s.

Why Mr Lavrov should be reluctant to acknowledge Israel as the Jewish State in these circumstances seems very curious indeed.

Certainly the PA has railed against making any such concession. This has been one of the major stumbling blocks to resolving the conflict that firstly the Oslo Accords and then the Quartet-sponsored Reagan Roadmap were designed to end.

PA resistance to acknowledge the existence of a Jewish State is writ large in the Charter of the Palestine Liberation Organization which contains the following racist and Jew-hating provisions:
“Claims of historical or religious ties of Jews with Palestine are incompatible with the facts of history and the true conception of what constitutes statehood. Judaism, being a religion, is not an independent nationality. Nor do Jews constitute a single nation with an identity of its own; they are citizens of the states to which they belong. “ (Article 20)

“Israel is the instrument of the Zionist movement, and geographical base for world imperialism placed strategically in the midst of the Arab homeland to combat the hopes of the Arab nation for liberation, unity, and progress. Israel is a constant source of threat vis-a-vis peace in the Middle East and the whole world. Since the liberation of Palestine will destroy the Zionist and imperialist presence and will contribute to the establishment of peace in the Middle East, the Palestinian people look for the support of all the progressive and peaceful forces and urge them all, irrespective of their affiliations and beliefs, to offer the Palestinian people all aid and support in their just struggle for the liberation of their homeland.” (Article 22)

It really is time the Quartet took a stance and told the unelected and unconstitutional PA President - Mahmoud Abbas - who also is Chairman of the PLO and head of its largest faction - Fatah - that maintaining these provisions in the PLO Charter pose insurmountable obstacles to peace.

The Quartet had the opportunity to do this in Washington this week and was simply not up to the task.

Tony Blair had explained what the Quartet hoped to achieve when he stated on 26 June:
“I actually think this is a moment where we need to be quite bold, take the initiative and try and set out a framework for revitalising the negotiation. And if you did that and it succeeded, by the way, you completely transform the situation.”

Blair continued:
“What we’re working is to see whether it’s possible to get a framework of principles that could guide a negotiation. Because the problem at the moment is that the Palestinians particularly don’t want to go back into a negotiation with an Israeli government they frankly don’t really trust, unless they are assured that the negotiation is going to be steered in a way that produces something. So, the question is, and this is the relevance of President’s Obama’s speech and the various Quartet statements, the question is can we, as a – as a quartet, as an international community get an agreed situation as to – as to what’s the framework within which you then have a negotiation.”

Any such boldness and initiative disappeared down the drain this week.

Israel has already made it perfectly clear it was ready to sit down and negotiate with the PA without preconditions. The PA refuses to do so. That is its perfect right - but it must be made aware there is a price to pay.

The quickest way to get both parties to negotiate is to let the PA know in no uncertain terms that the failure to negotiate unconditionally and immediately will result in the Quartet walking away and leaving the parties to their own devices.

Seven years of failed diplomacy by the Quartet has to come to an end at some time.

The Roadmap is negotiations based. By failing to get Israel and the PA to resume those negotiations - the two-state solution, Oslo, the Roadmap and the Quartet will continue to founder to their inevitable denouement should the PA unilaterally approach the UN in September.

Only firm and decisive action by the Quartet can have any chance of stopping this happening.

Given its poor performance this week the Quartet has not done its prestige or influence any good. It has only confirmed itself as being out of tune and out of time.

Goldstone Gazumped On Gaza

[Published 5 April 2011]

Richard Goldstone now faces bitter condemnation from Israel following his belated admission that his infamous Report was wrong in finding that Israel had intentionally targeted civilians during its invasion of Gaza in December 2008.

Goldstone has now attempted to lay the blame for this gross and defamatory libel at Israel’s feet for refusing to give evidence before his Inquiry - a kangaroo court and a UN sanctioned set-up in every sense. This claim is as outrageous as his earlier flawed findings.

Goldstone has belatedly confessed that the initial mandate given to him by the UN Human Rights Commission was “skewed” and was changed at his insistence. He goes even further in now stating:
“ I had hoped that our inquiry into all aspects of the Gaza conflict would begin a new era of evenhandedness at the U.N. Human Rights Council, whose history of bias against Israel cannot be doubted.”

But Goldstone still remains silent on his own bias and that of the other three members of his Tribunal - Hila Jalani, Desmond Travers and Christine Chinkin

The Hon. Sir Gerard Brennan AC KBE in evidence given to the Australian Senate on 10 August 2007 best sums up the role judges must assume and be seen to assume:
“There are qualities of character and disposition to be desired in all judges. The supreme judicial virtue is impartiality. Both partiality and the appearance of partiality are incompatible with the proper exercise of judicial authority. The one poisons the stream of justice at its source; the other dries it up”

Before their appointment as Commissioners by the President of the UN Human Rights Council on 3 April 2009 - Richard Goldstone, Hila Jalani and Desmond Travers were among 16 signatories who had signed an open letter to the United Nations Secretary General Ban Ki Moon and the Security Council Ambassadors on 16 March 2009 in which they stated:
“As individuals with direct experience of international justice and reconciliation of conflict, we believe there is an important case to be made for an international investigation of gross violations of the laws of war, committed by all parties to the Gaza conflict.

Without setting the record straight in a credible and impartial manner, it will be difficult for those communities that have borne the heavy cost of violence to move beyond the terrible aftermath of conflict and help build a better peace.

A prompt, independent and impartial investigation would provide a public record of gross violations of international humanitarian law committed and provide recommendations on how those responsible for crimes should be held to account.”

The words “credible”, “impartial“, and “independent” feature prominently in this part of the statement.

Not content however with stressing the nature of the investigation they desired - the signatories went on to declare:
“We urge world leaders to send an unfaltering signal that the targeting of civilians during conflict is unacceptable by any party on any count. We call on them to support the establishment of a United Nations commission of inquiry into the Gaza conflict. The commission should have the greatest possible expertise and authority and: a mandate to carry out a prompt, thorough, independent and impartial investigation of all allegations of serious violations of international humanitarian law committed by all parties to the conflict”

Again the signatories stressed the commission of inquiry was to be “impartial” - yet they had already concluded there had been targeting of civilians.

The letter continued :
“The events in Gaza have shocked us to the core.”

Surely given the public display of their feelings - and the conclusions they had already publicly drawn - the appointment of these three signatories to the Commission should never have been made.

But there is more that can be gleaned when one looks at their qualifications as set out in that letter.

Desmond Travers disclosed he was currently a Director at the Institute for International Criminal Investigations (IICI). Hila Jalani failed to mention she was also a director at the same Institute. Richard Goldstone did not mention that he was on the Council of Advisors of the same Institute.

Perhaps this failure of disclosure of association could be explained as an oversight by one or other of them in failing to reveal their close professional and working relationship, their ability to influence each other or even have a common mindset devoid of any of them exercising their own independent judgement.

However when one looks at the United Nations Press Release dated 3 April 2009, more detailed curricula vitae of these three Commissioners are given - but again their common identification with the IICI is not disclosed.

Additionally Richard Goldstone is disclosed as having been a Governor of the Hebrew University of Jerusalem. Surely he should have disqualified himself on that fact alone. But he didn’t. He said he was ‘‘shocked, as a Jew,’’ to be invited to head the mission.
‘‘It adds an additional dimension .I’ve taken a deep interest in what happens in Israel. I’m associated with organizations that have worked in Israel. And I believe I can approach the daunting task that I have accepted in an even handed and impartial manner.’‘

Goldstone apparently believed he could be even handed and impartial, But that is not the test. Any semblance of partiality should have resulted in his disqualification.

Chinkin had similarly placed herself in a position of conflict by signing a letter which appeared in The Times on 11 January 2009 stating:
“Israel’s bombardment of Gaza is not self-defence - it’s a war crime.”

In addition, the letter continued:
“The rocket attacks on Israel by Hamas deplorable as they are, do not, in terms of scale and effect amount to an armed attack entitling Israel to rely on self-defence…Israel’s actions amount to aggression, not self-defence”.

All four Commissioners should have recused themselves from sitting. They all share responsibility for the enormous harm suffered by Israel as a result of their refusal to do so.

The decent and fair thing for them all to do now would be to formally advise the Human Rights Council to tear up their Report and for all UN proceedings discussing the Report to be expunged from the UN records.

Israel Over The Moon With Ban-Ki

[Published 3 August 2010]

Israel is to be applauded for its agreement to participate in the Inquiry announced yesterday by UN Secretary-General Ban-Ki moon into the aborted attempt on 31 May by a flotilla of six ships to break the naval blockade imposed by Israel on the entry of goods and supplies into Gaza.

This Inquiry - first mooted in a statement by the UN Security Council on 1 June - called for :

” a prompt, impartial, credible and transparent investigation conforming to international standards"

The attempt by another United Nations organ - the Human Rights Council (UNHRC) - to hijack such an investigation and inflict as much political damage as it could on Israel has now been effectively terminated by the Secretary-General’s announcement.

The UNHRC on 23 June had indicated it would be initiating an investigation - which promised to be biased and far from independent - one that Israel could not possibly co-operate with.

The UNHRC had already prejudged the issues as was clearly evident in the terms of the resolution that it passed:

“to dispatch an independent, international fact-finding mission to investigate violations of international law, including international humanitarian and human rights law, resulting from the Israeli attacks on the flotilla of ships carrying humanitarian assistance;"

Any idea that there might not have been any violations of international law or that the ships might not have been carrying only humanitarian assistance had already been predetermined by the UNHRC in this blatantly worded resolution.

Israel had been effectively hung drawn and quartered by the UNHRC before the members of its Inquiry had even been named.

So far as the UNHRC was concerned it had:

(i) Condemned in the strongest terms the outrageous attack by the Israeli forces against the humanitarian flotilla of ships, which resulted in the killing and injuring of many innocent civilians from different countries;
(ii) Deeply deplored the loss of life of innocent civilians, and expresses its deepest sympathy and condolences to the victims and their families;
(iii) Called upon the occupying Power, Israel, to immediately lift the siege on occupied Gaza and other occupied territories;

without hearing one word from Israel.

This identical pattern of prejudging Israel had been established by the UNHRC when appointing the Goldstone Inquiry into Israel’s invasion of Gaza in December 2008. Israel had no option but to then refuse becoming a sacrificial lamb in such an Inquiry whose outcome had been pre-determined before the Commission had even begun its work and whose Commissioners were totally conflicted by statements they had made before their appointment. Any hope of Israel getting a fair hearing were doomed from the outset.

The UN has proved far more circumspect on this latest occasion and the UNHRC has been sent packing.

Israel’s agreement to now participate in the Secretary-General’s Inquiry - to be co-chaired by New Zealand’s Sir Geoffrey Palmer and Columbia’s Alvaro Uriba with the addition of one representative from Israel and one from Turkey - promises to provide a fair and transparent setting for the determination of the events that lead to the blockade being instituted, the attempts to undermine it and the tragic consequences that followed.

Issues such as the legality of the blockade and its enforcement, provocation, the use of force, disproportionate use of force and acting in self defence will be examined and appropriate judgements made.

The terms of reference are still to be finalised but Sir Jeffrey Palmer has charted an optimistic course stating:

“I can’t say anything of substance on the details of this inquiry or indeed its procedures until I’ve been to New York and discussed the issues with both the Secretary General [Ban Ki-moon] and my colleagues on the inquiry… This is a very sensitive matter. It’s a quasi-judicial inquiry, so it is really very important to maintain a sense of detachment”

Hopefully the details and procedures when released will prove to be fair and balanced and enable Israel and Turkey to appoint representatives to the Committee and allow its deliberations to proceed in an atmosphere of calm. The Inquiry should certainly serve to ease tensions between Israel and Turkey.

Hopes are high that the UN might at last have hit on a path to reducing conflict that will see the last of any flawed and unreliable inquiries such as that conducted by Goldstone.

Israel’s Prime Minister Netanyahu has said - following the announcement of the Inquiry:

“Israel has nothing to hide. Quite the opposite: The State of Israel’s national interest is to ensure that the factual truth on the entire raid incident will be known to the world”

Israel’s President - Shimon Peres - is confident Israel will be exonerated.

In an interview with Benny Morris published on 26 July Peres was asked and responded to the following questions:

“Q: About the Turkish flotilla, do you think we acted correctly?

A: We acted correctly, except in terms of explaining what happened.

Q: We killed nine Turks, they killed no Israelis.

A: There were six boats. Only on one — where they came prepared for violence — was there a clash. There was a long delay in broadcasting our explanation. There is no starvation in Gaza and no siege. If Gaza would agree not to rocket us, we would leave the entry points open.

Q: But we prevented items like cardamom from reaching Gaza.

A: OK, we made some mistakes. [But] we made another mistake—we restrained ourselves for eight years and allowed them to shoot thousands of rockets at us until the rage came out at one go [in the IDF assault on Hamas in Gaza in 2008-2009]. Had we done then what we do now, retaliate each time they fire a rocket — there would have been no problem. In the end, it turned out that restraint was a mistake"

Israel will now be given the chance of fully explaining what happened in a forum that will hopefully act responsibly and carefully without resort to reliance on innuendo and unsubstantiated allegations.

The precedent created by this Inquiry could lead to the UN undertaking similar inquiries into future international incidents between conflicting antagonists.

It serves to end the political grandstanding and double standards of organizations such as the UNHRC and the Arab League - whose member countries include some of the worst abusers of human rights and violators of international law among the international community.

United Nations Must Liberate Gazans - Not Gaza

[Published June 2010]

The statements issuing from senior United Nations officials following the two failed attempts by the Free Gaza Movement (FGM) to break Israel’s blockade of Gaza during the past week were strident and uncompromising - but entirely misdirected and unhelpful in seeking an end to the misery and suffering being endured by Gaza’s civilian population.

UN Secretary General Ban Ki-Moon headed the protests condemning Israel’s failure to allow the blockade to be breached stating:

“The long-running closure imposed on the Gaza Strip is counter-productive, unsustainable and wrong. It punishes innocent civilians. It must be lifted by the Israeli authorities immediately.”

The Secretary General was supported by Assistant Secretary-General for Political Affairs Oscar Fernandez-Taranco who told the UN Security Council that :

“today’s bloodshed would have been avoided if repeated calls on Israel to end the counterproductive and unacceptable blockade of Gaza had been heeded…the blockade is unacceptable and counterproductive and must end.”

Not wishing to be left out on a limb - Richard Falk - the Special Rapporteur on the situation of human rights in the occupied Palestinian territory - characterized the blockade of Gaza as a

“massive form of collective punishment… Unless prompt and decisive action is taken to challenge the Israeli approach to Gaza all of us will be complicit in criminal policies that are challenging the survival of an entire beleaguered community,”

Strangely missing from all three statements was any mention or criticism of:

(i) Egypt - which had also been maintaining the blockade of Gaza for as long as Israel.

(ii)Hamas - which had assumed control of Gaza in 2007 after a bloody internecine struggle with the Palestinian Authority - leading to the joint blockade of Gaza by Israel and Egypt in an attempt to restrict the flow of arms, war materials and terrorists into Gaza.

(iii)The FGM - whose motives in organizing the attempted breaches of the blockade went far beyond those of a humanitarian organisation purely seeking to end the suffering of the Gazans.

The FGM’s end game is identical to that of Hamas - the destruction of Israel as the national homeland of the Jewish people. This is not a secret agenda but is made very clear in its mission statement which declares:

“6. We recognize the right of all Palestinian refugees and exiles and their heirs to return to their homes in Israel and the occupied Palestinian territories; to recover their properties, and to receive compensation for damage, dispossession and unlawful use of such property. This is an individual and not a collective right, and cannot be negotiated except by the individual”

The FGM is perfectly entitled to espouse such views. However the insistence on this right of return has been one of the main stumbling blocks in arriving at the “two-state solution” over the last 17 years.

Israel will not accept this demand - whether it is sought to be enforced by individuals or by either Hamas or the Palestinian Authority. Compensating both Palestinian Arab refugees as well as Jews who fled Arab countries following the 1948 War through the establishment of an international claims tribunal offers a possible way forward.

However if return - rather than compensation - is to be pressed then it can only ever come about as a result of conflict - which will make the current humanitarian problem in Gaza pale into insignificance by comparison with the humanitarian crisis that would be created if force was employed to achieve this objective.

Breaking the blockade will greatly strengthen Hamas in pursuing the right of return that the FGM also openly calls for - by allowing Hamas the freedom to bring into Gaza whatever weapons and terrorists it wants.

The FGM does not seem to be too concerned that in seeking to end the suffering of the Gazans this might become the prelude to inflicting suffering on the Israelis as Hamas pursues its stated aim of liberating Palestine.

The Gazans therefore remain stuck between Israel and Hamas as human shields to deter any military efforts by Israel to defeat this Hamas end game. Their plight has become increasingly evident since Israel’s unsuccessful attempt to rid Gaza of Hamas control in January 2009.

The UN are being taken for fools and need to rethink their attitude to Gaza.

If the UN truly wishes to end the privation and suffering of the Gazans then there is only one way out of the current predicament - the evacuation of the Gazans from Gaza.

The Gazans are in a situation fraught with danger as they live between two combatants - Israel and Hamas . Gazans need to be offered the opportunity to evacuate Gaza to safer havens until it is safe for them to return to Gaza.

Evacuation through Egypt to those countries willing to accept the evacuees should not be beyond the capacity of the 191 countries that make up the UN. Certainly the 57 states that comprise the Organization of the Islamic Conference must play a leading role in accepting the evacuees.

Israel was able to absorb one million refugees from Russia. It should not be beyond a concerned world to accommodate a similar number of Gazan evacuees on a temporary basis until circumstances permit their return to Gaza.

Certainly many Gazans will not want to be evacuated - but all should at least be given the opportunity to do so by the UN.

Israel will not be ending its blockade though it may well ease it. However useless calls such as those emanating from the Secretary General and his minions calling for an end to the blockade will continue to be rejected - with good reason - by Israel.

Israel is entitled in its national interest to do everything in its power to blunt Hamas and secure the safety and security of all Israelis - both Jews and Arabs.

Instead of futilely continuing to challenge Israel’s approach to Gaza - the UN should try to do something positive to end the humanitarian crisis in Gaza.

Failure to implement a policy of evacuation of Gaza’s civilian population will indeed make the UN complicit in failing Gaza’s beleagured community when it had the opportunity to end their current suffering - but did nothing constructively to do so.

The UN at the very least must follow the practice of its own High Commissioner for Human Rights — Navi Pillai - who at the height of the Sri Lanka conflict in 2009 called for the evacuation of the entire civilian population by land or sea.

Failure to similarly do so now in the case of Gaza will condemn the UN as a totally impotent, biased and irrelevant body.
