Will President Trump say “West Bank” or “Judea and Samaria”?

President Trump - having rejected a barrage of criticism since describing himself as a “nationalist” - faces a further torrent of invective should he choose to say “Judea and Samaria” rather than “West Bank” in his soon to-be-released peace proposals.

Arab propaganda has used “West Bank” since 1949 to obliterate any Jewish connection to one of the two remaining pieces of land under the League of Nations Mandate for Palestine where sovereignty still remains undetermined between Jews and Arabs.

Even worse — the United Nations and US State Department have continued using this deceptive and misleading terminology since 1967.

The media and political commentators have sought to relegate the historical-geographical term “Judea and Samaria” to some ancient biblical anachronism that fell into disuse centuries ago — yet that term appears in the 1911 Encyclopaedia Britannica and the UN 1947 Partition Plan resolution.

Incontrovertible Jewish claims to this hotly-disputed territory – about the size of Delaware – were eloquently summarised in the Forward on 12 July 1991:
“As for “Judea” and “Samaria”, they are indeed ancient names, but the notion that they had become “archaic” prior to 1967 is totally false for both English and Hebrew. Indeed, unlike their Moslem counterparts, not only Jewish, but Christian geographers too, from Roman times onward, always considered the mountainous regions north and south of Jerusalem to be discrete entities, since this is how the Old and New Testaments speak of them because of the separate Judean and Israelite kingdoms that existed there. As late as many 18th-, 19th- and early 20th-century atlases, it is possible to find accurate maps of Palestine with the major Arab towns and villages appearing beside the words “Judea” and “Samaria” in large print.

The Hebrew terms, yehuda and shomron have had a slightly more complex history — rather, shomron has had, since yehuda, “Judah” which was originally the name of the tribe that occupied the southern hill country of the Land of Israel, has been in uninterrupted use as a geographical term since the Book of Deuteronomy. We find it and it alone in the Mishnah and the Talmud; in the account of the famous 12th-century Jewish traveller Benjamin of Tudela; in Kaftor u-Ferach, a 16th-century halakhic geography of Palestine composed by the Italian Rabbi Ishtori Haparhi; in all the 19t- and 20th-century literature of Zionist settlement in Palestine; and in thousands of other Hebrew sources from every period of Jewish history as well.

The case of “shomron”, “Samaria”, is somewhat different. The oldest Hebrew name for the mountains north of Jerusalem is not shomron but efrayim, after the tribe whose territory it was. Shomron was originally a site in Efrayim that, in the reign of King Omri, became the capital of the northern Kingdom of Israel, which eventually began to bear its name. Thus, in the Hebrew Bible we find shomron, efrayim, and yisra’el used interchangeably, while in rabbinic literature they are joined by a fourth term: eretz ha-kutim, “the Land of the Cuthites”—a reference to the Samaritans, a population originally transferred from the Babylonian region of Kutu to take the place of the “ten lost” tribes of Israel deported by the Assyrians in 721 B.C.E.

Subsequently, all four of these terms were used by Jewish sources, although the last two dropped out in the Middle Ages; it was not however, until the conquest of the area in 1967 that “Shomron” was finally recognized instead of “Efrayim”.

President Trump should use “Judea and Samaria” to end 70 years of fraudulent Arab propaganda — aided and abetted by the United Nations, the US State Department and the President’s oft designated“fake media".

United Nations loses the plot in ignoring Israel-Jordan reality

29th November 2017 marks the 70th anniversary of United Nations General Assembly Resolution 181 (II) (Resolution) calling for the creation in Western Palestine of independent Arab and Jewish States and a Special International Regime for the City of Jerusalem (Partition Plan).

The Resolution did not mention:
1. the “West Bank (a term dreamed-up in 1950) — using instead the terms “Judea” and “Samaria” - their correct geographical place names for the previous 3000 years

2. a “Palestinian State” - only an “Arab State”

3. one Arab State had already been created in Eastern Palestine on 25 May 1946 named the Hashemite Kingdom of Transjordan covering 78% of the territory comprised in the 1922 League of Nations Mandate for Palestine (Mandate).
The Partition Plan was accepted by the Jews but vehemently rejected by the Arabs.

H. R. H. Amir FAISAL AL SAUD (Saudi Arabia) fulminated:
"We have felt, like many others, the pressure exerted on various representatives of this Organization by some of the big Powers in order that the vote should be in favour of partition. For these reasons, the Government of Saudi Arabia registers, on this historic occasion, the fact that it does not consider itself bound by the resolution adopted today by the General Assembly. Furthermore, it reserves to itself the full right to act freely in whatever way it deems fit, in accordance with the principles of right and justice"

Mr. JAMALI (Iraq) protested:
"In the name of my Government, I wish to state that it feels that this decision is antidemocratic, illegal, impractical and contrary to the Charter. It contradicts the spirit and letter of the Charter. Therefore, in the name of my Government, I wish to put on record that Iraq does not recognize the validity of this decision, will reserve freedom of action towards its implementation, and holds those who were influential in passing it against the free conscience of mankind responsible for the consequences"

Amir ARSLAN (Syria) joined the chorus:
"Gentlemen, the Charter is dead. But it did not die a natural death; it was murdered, and you all know who is guilty.

My country will never recognize such a decision. It will never agree to be responsible for it. Let the consequences be on the heads of others, not on ours"

H. R. H. Prince Seif El ISLAM ABDULLAH (Yemen) was just as condemnatory:
"The Yemen delegation has stated previously that the partition plan is contrary to justice and to the Charter of the United Nations. Therefore, the Government of Yemen does not consider itself bound by such a decision for it is contrary to the letter and spirit of the Charter. The Government of Yemen will reserve its freedom of action to-wards the implementation of this decision."

This implacable Arab rejectionism was the catalyst for the 1948 invasion of Western Palestine by six Arab armies and the perpetuation of the Arab-Jewish conflict for the next 70 years.

2017 sees:
1. Iraq, Syria and Yemen as failed states - with Saudi Arabia in danger of joining them.

2. The General Assembly sinking in quicksand of its own making after creating “The Committee on the Exercise of the Inalienable Rights of the Palestinian People” in 1975 and adopting countless resolutions using emotive and artificially-contrived terms such as:
“West Bank”
“Occupied Palestinian Territory”
“historic Palestine”
“Palestinian People”
“Palestinians”
“Palestinian State”
“two-state solution”
The United Nations continues to lose the plot whilst it:
1. Uses such deceptive and misleading language

2. Fails to recognise that Jordan and Israel are the two successor states currently exercising sovereignty in 95% of former Palestine.
The United Nations must resurrect 1947 reality and abandon 2017 fiction.

Palestine - France Farce And Folly

France embarked on a journey to nowhere when it hosted 28 delegations in Paris for a ministerial meeting on 3 June marking the first phase of its initiative aimed at promoting peace in the Middle East.

Amid the pomp and ceremony, photo opportunities and handshakes - the final communique revealed:

1. Support was reaffirmed for a just, lasting and comprehensive resolution to the Israeli-Palestinian conflict.
The conflict actually requiring resolution is the Jewish-Arab conflict going back to 1917—well before Israel’s creation in 1948 — which still sees 20 Arab States today denying the Jews the legal rights vested in them by the Mandate for Palestine to reconstitute the Jewish National Home in its ancient biblical and historical homeland.

Only Jordan and Egypt have recognised and signed peace treaties with Israel.

The “Palestinians” were regarded as part of the “existing non-Jewish communities in Palestine” by the League of Nations in 1922 and not recognized as a people by the United Nations in the 1947 Partition Plan.

The 1964 PLO Covenant is their birth certificate.

PLO Chairman Mahmoud Abbas’s claim on 6 June that the “Palestinians” had a 5000 years old history is farcical.

Paris remained blinded.
2. A negotiated two-state solution was reaffirmed as the only way to achieve an enduring peace, with two states, Israel and Palestine, living side by side in peace and security.
That “two-state solution” - first proposed in 1947 - was available at any time between 1948 and 1967, was again offered in 2000/1 and 2008 but was always rejected by the Arabs.

Flogging that dead horse is a waste of time.

The “two- state solution” envisioned by the League of Nations in 1922 and the Peel Commission in 1937 provides the best opportunity for peacefully resolving Jewish and Arab territorial claims in Judea and Samaria (West Bank) and Gaza.

Guess the delegates were too busy quaffing champagne and tasting canapes to focus on other solutions than the artificially contrived, totally failed and utterly discredited 1947-2016 “two-state” solution.
3. Rebuilding trust and creating the conditions for fully ending the Israeli occupation that began in 1967 and resolving all permanent status issues through direct negotiations based on resolutions 242 (1967), 338 (1973), and also recalling relevant United Nations Security Council resolutions and highlighting the importance of the implementation of the Arab Peace Initiative.
"Fully ending” the 1967 occupation means kicking 650000 Jews out of their homes. What were they thinking — and drinking?

Israel agreed to negotiate with the PLO under the 2003 Bush Roadmap only on the basis of Security Council Resolutions 242 and 338.

Introducing new negotiating parameters now is incredibly fanciful.
4. Possible ways in which the international community could help advance the prospects for peace, including by providing meaningful incentives to the parties to make peace.
Direct negotiations between Israel, Jordan and Egypt would fit these objectives.
5. The participants highlighted the key role of the Quartet.
The Quartet lost its key role in July 2015 when:
(i) The Quartet’s representative Tony Blairstood down with no replacement

(ii) Blair’s office — the Office of the Quartet Representative (OQR) - was renamed the Office of the Quartet (OQ) and its stated mandate was expressed:
“to support the Palestinian people on economic development, rule of law and improved movement and access for goods and people, as they build the institutions and economy of a viable and peaceful state in Gaza and the West Bank, including East Jerusalem.”

(iii) Jews became persona non grata overnight as the Quartet’s previously independent non- partisan role was superseded.
France’s follow-up international conference being organised before the end of the year promises further farce and continuing folly.

Palestine - Internet Intifada On Free Speech Intensifies

An increasing number of anti-Jewish and anti-Israel websites are banning comments made by me in response to articles or readers’ comments published on their sites.

These websites have:
1. Simply not posted my comments or

2. Deleted all published comments – including mine - when factual errors pointed out by me cannot be successfully challenged or denied - thereby exposing the unquestionable venom and hate being spewed out on these websites
The latest novel attempt to blatantly silence me recently reared its ugly head when I attempted to respond to this reader’s offensive and unsubstantiated comment:
"Wow — “smug” is the perfect word for this effing Zionist.

Great post — thank you!

Go BDS! Go every other effort to expose and dispose of the criminally psychotic ideology Zionism and its every adherent! Viva Palestine!"

My response was not published.

Mysteriously however another even more offensive comment was posted by the same reader responding to my unpublished comment:
"David Singer, I found your:

RIP Palestine. All this nonsense could have been avoided had the Arabs accepted the 1947 UN Partition Plan or created a second Arab state in former Palestine – in addition to Jordan – between 1948 and 1967 after all the Jews living in the West Bank and Gaza had been driven out by six invading Arab armies.


The Arabs need to step up to the plate and accept the consequences of those decisions which have caused so much grief to Jews and Arabs since."

at my incoming e-mail site. Now, why should the already dispossessed, scattered Palestinian polity — you know the stats: at least 750,000 cleansed from their land, up to 500 villages razed by Zioterrorists by 1949 — have accepted an illegal move engineered by Zionist schemers (who bragged of “having it all” even then) and foisted on the fledgling UN (the GA at that) in November 1947? The Palestinians wanted justice and their own independent state then and they’ve steadfastly sought justice and fulfillment of their legitimate aspirations ever since. “nonsense,” bullxxxt!

Enough, already, of your “singing,” Singer."

Well might you ask - how did my unpublished comment make its way into this crude reader’s email box without it being published on-line first?

The saga does not end there.

I then endeavoured to post the following response:
"You state:

“The Palestinians wanted justice and their own independent state then and they’ve steadfastly sought justice and fulfillment of their legitimate aspirations ever since”

The Palestinian Arabs could have had their own independent State in 1947 in a much larger share of former Palestine than is available to them now under any negotiated settlement in 2016 - if they had not rejected the UN Partition Plan.

Do you agree?

You are also silent on the fact that they could have also had their own independent State in all the West Bank and Gaza and even East Jerusalem between 1948 and 1967 when not one Jew lived there and Jordan and Egypt were the occupiers. That could have happened with the stroke of an Arab League pen.

Do you agree?

Those golden opportunities will not return.

The Palestinian Arabs and their Arab brethren in the Arab League have blown it well and truly.

They will have to settle for a lot less than 100% of the West Bank, Gaza and East Jerusalem if they want to make peace with Israel.

Suppressing free speech on these insidious websites must be continually exposed and roundly condemned.

Deliberately manipulating these hate-filled websites perpetuates an unchallenged aura of lies and distortions that are misleadingly and deceptively influencing readers’ opinions on the Arab-Jewish conflict.

Palestine - Internet Intifada Denies Free Speech

Many Palestinian websites are stifling free speech by refusing to publish comments answering anti-Israel articles published on their sites.

The latest example is an article written by Rania Khalek on Electronic Intifada

Responding to the decision by McGraw Hill Education to destroy all copies of its text book Global Politics: engaging a complex world - containing the accompanying maps - Khalek claimed:
“The maps, which appear in chronological succession on page 123, show Palestinian land loss from 1946, one year before Zionist militias initiated the displacement of more than 750,000 indigenous Palestinians from historic Palestine, to the year 2000, by which point Palestinian land had been reduced to a handful of tiny non-contiguous enclaves in the occupied West Bank and a sliver of Gaza.”

I endeavoured to post the following comment in response on 21 March pointing out the misleading nature of these maps:
“Map 1:
The heading - “Palestinian and Jewish Land 1946” - is misleading for the following reasons:
(i) The map excludes Transjordan which in 1946 still comprised 78% of the territory of the Mandate for Palestine until granted independence by Great Britain in May 1946.

(ii) The land described as “Palestinian land” misleadingly implies legal ownership by the Palestinian Arabs of that land when in fact about 90% of it was State land under British Mandatory control and legal power of disposition.

Map 2:
(i) The legend “Palestinian land” is misleading.

(ii) The legend should have said “proposed Jewish State” and “proposed Arab State” - the terms used in the UN Partition Plan.

Map 3:
The heading “1949-1967” is misleading.

The map should have shown the unification of the West Bank with Transjordan between 1949 and 1967 and the change of name of Transjordan to Jordan in 1950.

It should also have designated the Gaza Strip as being under Egyptian military administration between 1948-1967.

Map 4:
One can only wonder why the year 2000 was chosen. Why not 2015 after Israel had already withdrawn from Gaza and four settlements in the West Bank in 2005 and dismantled many illegal outposts?

In any event the legend “Palestinian land” and “Israeli land” is again wrong and misleading in so far as it relates to the West Bank. The land there should have been shown as Areas “A”, “B” and “C”

As maps designed to be taught to students they are totally lacking in accuracy and ignore basic facts in their compilation.

Designating land as “Palestinian land” in any event implies that such land belongs to the “Palestinians”. Since there were no persons designated as “Palestinians” until the 1964 PLO Charter defined that term—the use of the term in maps before then smacks of an attempt to re-write history.

Mc Graw Hill had no option but to discard these maps”

My comments have not yet been published - and comes at a particularly sensitive time as Electronic Intifada Editor Ali Abunimah - a US citizen - has recently received a visa from the Australian Government - after waiting two months - to speak at a four day Marxism Conference and at other venues in Australia.

Abunimah posted the following tweet thanking the thousands who had petitioned the Australian Government supporting the grant of his visa:
“I’m so grateful to every person who stood up for free speech. Delighted that I just received my visa for Australia. See you Down Under!”

Free speech means free speech for all Mr Abunimah.

Palestine - United Nations Bedazzled By Abbas Word Wizadry

PLO Chairman Mahmoud Abbas’s speech to the UN General Assembly last week contained a concoction of half-truths and outright lies that everyone who listened to him should question.

Here are some prize porkies:
1. “The question of Palestine was one of the first just issues brought before the United Nations from the time of its inception, and yet it remains unresolved until this moment”

Abbas failed to mention that it has remained unresolved since then because:
(i) The Arabs did not accept the 1947 UN Partition Plan to partition western Palestine into a Jewish State and an Arab State — whilst the Jews did.

(ii) The Arabs — instead - unsuccessfully sent six Arab armies to invade Palestine in May 1948 to rout the newly declared Jewish State — Israel - and drive its Jewish population into the sea

(iii) Jordan and Egypt successfully drove out and permanently expelled the Jewish population living in the Gaza Strip, East Jerusalem and Judea and Samaria (later termed “the West Bank”) - keeping those areas Jew-free from 1948 until 1967

(iv) No attempt was made between 1948 and 1967 to create the Palestinian state Abbas says he will now accept. That opportunity has been well and truly missed.
2. Abbas described the Palestinian Arabs as “a people that had lived peacefully in their land and made genuine intellectual, cultural and humanitarian contributions to mankind.”
Abbas was gilding the lily.
(i) The Arab riots in Jerusalem in 1920, the Hebron massacre of the Jewish community in 1929 and the Arab riot between 1936 and 1939 give the lie to his claims.

(ii) No genuine intellectual, cultural and humanitarian contributions have been made to mankind by the Palestinian Arabs — unless airline hijackings, suicide vests, and indiscriminate targeting of Jews is what Abbas had in mind
3. “While Palestine was partitioned into two states — according to which Israel was established 67 years ago - the second part of that resolution still awaits implementation.”

Abbas suffers from a selective memory.
(i) Palestine was effectively divided 92 years ago in 1923 - when 78% - originally designated for the Jewish National Home by the 1920 San Remo conference and the Treaty of Sevres — was denied to Jewish settlement by article 25 of the Palestine Mandate.

(ii) This area subsequently became the Jew-free independent Hashemite Kingdom of Transjordan in 1946 - renamed Jordan in 1950 after being unified with Judea and Samaria.
4. “We recall here the words of the late Israeli Prime Minister Yitzhak Rabin in 1976, when he stated that Israel will become an apartheid state if it continues its occupation of the Palestinian territory and described the Israeli settlements on Palestinian land as “cancer”.

Abbas misleadingly failed to tell the General Assembly that Rabin’s view had changed markedly just before his assassination in 1995 — after experiencing 19 years of unremitting terrorism and rejectionism by the PLO — telling the Knesset:
(i) The borders of the State of Israel would be beyond the lines which existed before the Six Day War. Israel would not return to the 4 June 1967 lines.

(ii) Jerusalem would be united and would include both Maale Adumim and Givat Zeev as the capital of Israel under Israeli sovereignty

(iii)The security border of Israel would be located in the Jordan Valley, in the broadest meaning of that term

(iv) Gush Etzion, Efrat, Beitar and other communities in the area east of what was the “Green Line” prior to the Six Day War would be included in the State of Israel;

(v) Blocs of settlements would be established in Judea and Samaria like the one in Gush Katif

(vi) No single settlement would be uprooted in the framework of the Interim Agreement, nor building hindered for natural growth
5. “Palestine is a country of holiness and peace. It is the birthplace of Christ, the messenger of love and peace, and the Isra’ and Mi’raj (ascension to heaven and night journey) of Mohammed”

Abbas omitted any mention of the Jews — the forebears of the Christians
6. “It is no longer useful to waste time in negotiations for the sake of negotiations; what is required is to mobilize international efforts to oversee an end to the occupation in line with the resolutions of international legitimacy.”

(i) Abbas supposedly supports “resolutions of international legitimacy” — yet the PLO he heads has declared that the Balfour Declaration, the Mandate for Palestine, and everything that has been based upon them, are deemed null and void.

(ii) The League of Nations Mandate for Palestine and article 80 of the United Nations Charter are resolutions of international legitimacy that cannot be swept away because Abbas does not like them.
7. "The state of Palestine, based on the 4th of June 1967 borders with East Jerusalem as its capital, is a state under occupation, as was the case for many countries during World War II.”

(i) “The state of Palestine” does not meet the legal requirements of customary international law as encapsulated in the 1933 Montevideo Convention.

(ii) There were no borders — only armistice lines.

(iii) How can “Palestine” be a state under occupation since there was no such State in existence prior to 1967?
The applause accorded Abbas in the UN General Assembly indicates how his deceptively misleading word wizardry continues to confound attempts to end the 100 years old Jewish-Arab conflict.

Exposing its false peddlers must never cease.

Time the United Nations woke up and restored its own credibility.

Palestine - Racist And Apartheid Policies Plague Peace Proposals

Mahmoud Abbas - President of Palestine and the Palestinian Authority - Chairman of the Palestine Liberation Movement (PLO) and Fatah - the PLO’s largest faction - has doomed to the garbage bin any possible peace proposals that might be offered by Israel’s new National Unity Government - following his latest outburst in the Lebanese newspaper An-Nahhar:
“We won’t agree to recognize something called the Jewish state. Why wasn’t this issue raised when Israel negotiated with Jordan and Egypt?”

Abbas’s highly inflammatory remark is just one of many similar statements that have been made in the past.

Abbas has clearly indicated that he has no intention of mitigating his view that there is no place for a Jewish State in its biblical and historical homeland - nor in the Palestinian Arab state that he now heads that was internationally recognized on 31 October 2011 with Palestine’s admission to UNESCO as its 195th member state.

His comment only shows that nothing has really changed in the racist policies adopted by the Palestinian Arabs since their rejection of the 1947 United Nations Partition Plan proposing the creation of a Jewish state and an Arab state in what was then left of Mandatory Palestine following the creation in 1946 of the Hashemite Kingdom of Transjordan - now called Jordan - on 78% of the territory initially slated for reconstitution of the Jewish National Home.

What is even worse and very worrying is the deafening silence from the international community to Abbas continuing along this racist and apartheid path.

Abbas apparently seems perplexed that the issue of a Jewish state was never raised in negotiations when peace treaties were negotiated between Israel and Egypt and Israel and Jordan.

The answer is very simple.

Neither Egypt nor Jordan had enshrined in their constitutions or their policies any provision remotely approaching clause 20 of the PLO Charter:
“The Balfour Declaration, the Mandate for Palestine, and everything that has been based upon them, are deemed null and void. Claims of historical or religious ties of Jews with Palestine are incompatible with the facts of history and the true conception of what constitutes statehood. Judaism, being a religion, is not an independent nationality. Nor do Jews constitute a single nation with an identity of its own; they are citizens of the states to which they belong.”

Neither did Egypt or Jordan expressly embrace the policy of Hamas - the Islamic Resistance Movement - as espoused in Article 11 of its Charter:
“The Islamic Resistance Movement believes that the land of Palestine is an Islamic Waqf consecrated for future Moslem generations until Judgement Day. It, or any part of it, should not be squandered: it, or any part of it, should not be given up. Neither a single Arab country nor all Arab countries, neither any king or president, nor all the kings and presidents, neither any organization nor all of them, be they Palestinian or Arab, possess the right to do that. Palestine is an Islamic Waqf land consecrated for Moslem generations until Judgement Day.”

Yet Hamas is a movement that Abbas is desperately seeking to bring into a future unity Government under his control.

Until the PLO and Hamas unequivocally revoke and abandon these racist policies Israel has no other course but to insist that recognition of Israel as the national homeland of the Jewish people is a non-negotiable demand that is not to be compromised under any circumstances in any future negotiations with Abbas.

The campaign of Boycott Divestement and Sanctions (BDS) - promoted and actively supported by Abbas and the Palestinian Authority has been properly described as:
“a negative and one-sided campaign aimed at demonising Israeli Jews irrespective of their political views on the Palestinian question.”

Penalizing individual Jews financially and economically by boycotting the purchase of their goods and the provision of their services is racist and discriminatory. Yet many in the international community continue to warm to such policies - rather than expressing a total loathing and revulsion at such attempts to deny the right of Jews to be treated equally with their Moslem and Christian counterparts in the lawful pursuit of their right to freedom of trade and commerce.

Last played on the Palestinian Authority’s air waves on 12 May - and at least 24 times before then - is a song which contains the following lyrics:
“We commit and promise to stand behind you, oh Mahmoud Abbas, until Judgment Day.
I am returning to you, the purest land, oh land of the free. No matter how long the nights of exile,
I am returning to you, oh land. From Rafah to Rosh Hanikra (northern Israel) our coast, and Beit Shean (Israeli city).
Above your soil, oh my land, is a picture of Garden of Eden. From Rafah to Rosh Hanikra our coast, and Beit Shean.
Above your soil, oh my land, is a picture of Garden of Eden. From Rafah to Rosh Hanikra, north and south, are the picture’s borders.
From Haifa (Israeli city) and Tantura to the [Jordan] valley (i.e., all of Israel). I am returning to you, the purest land, oh land of the free.”

Abbas has also made it abundantly clear that he will tolerate any Jews living in any Palestinian Arab State.

The dissemination of such sentiments may be justified as part of the individual’s right to freedom of expression.

However, when such views are promoted and actively supported by the President of a State - the bona fides of the President and that State to sue for peace must be seriously questioned.

Given these recent expressions of open racism and official Government support of on-going efforts to isolate and denigrate Jews - one can confidently predict that nothing Israel offers will ever be acceptable to the Palestinian Arabs.

Palestine presently has a tenuous hold on Gaza and about 40% of the West Bank.

Statements and policies like those identified above ensure that these present areas of Palestinian statehood are not likely to be expanded any further.

Abbas needs to shape up - or ship out.

Palestine - "End The Occupation" And "Right The Wrongs"

I don’t think there has ever been any Arab propaganda slogan as powerful and successful as “End The Occupation”.

These three little words have managed to turn Israel’s miraculous victory in the 1967 Six Day War and its triumphal return to parts of the biblical and ancestral land of its forefathers - as something to be reviled and reversed.

Those mouthing the slogan have not sought to have the “occupation” ended in favour of Jordan - the previous Arab occupant during the period 1948-1967.

Rather they are insisting it all be given - albeit with mutually agreed land swaps - to another group - the “Palestinians” - who did not exist
(i) in 1937 - when the Peel Commission issued its Report
(ii) in 1947 - when the United Nations recommended the partition of western Palestine into an Arab State and a Jewish State.
(iii) Between 1948-1964 - when no claim was made by any such group to territory that any Arab claimant could have gained by the stroke of an Arab League pen - after such territory had been ethnically cleansed of every single Jew who had been living there prior to 1948

The “Palestinians” only first saw the light of day in 1964 when the PLO Charter was promulgated and Article 1 declared:
"Palestine is the homeland of the Arab Palestinian people; it is an indivisible part of the Arab homeland, and the Palestinian people are an integral part of the Arab nation"

Article 5 went on to elaborate:
"The Palestinians are those Arab nationals who, until 1947, normally resided in Palestine regardless of whether they were evicted from it or have stayed there. Anyone born, after that date, of a Palestinian father - whether inside Palestine or outside it - is also a Palestinian."

No recognition was given to the fact that groups other than Arabs had lived in Palestine from time immemorial - long before the Arabs had ever conquered and occupied the area.

Ten years later - on 13 November 1974 - the leader of this newly created entity - Yasser Arafat - told the United Nations General Assembly:
"The PLO has earned its legitimacy because of the sacrifice inherent in its pioneering role, and also because of its dedicated leadership of the struggle. It has also been granted this legitimacy by the Palestinian masses, which in harmony with it have chosen it to lead the struggle according to its directives. The PLO has also gained its legitimacy by representing every faction, union or group as well as every Palestinian talent, either in the National Council or in people’s institutions. This legitimacy was further strengthened by the support of the entire Arab nation, and it was consecrated during the last Arab Summit Conference, which reiterated the right of the PLO, in its capacity as the sole representative of the Palestinian people, to establish an independent national State on all liberated Palestinian territory."

In 2011 the legitimacy of the PLO leadership role is in tatters. A new boy on the block- Hamas - has emerged to challenge the PLO’s claim and reconciliation between these two competing power bases is still not in prospect after six years of bitter internecine conflict.

The effort to reach a resolution of the 130 years old Arab-Jewish conflict has been stymied by the refusal of the PLO to sit down in direct face to face negotiations with Israel - but even if this were to occur tomorrow the prospects of any successful outcome would be extremely unlikely to eventuate.

Jordan sits on the sideline having abandoned any claim to Judea and Samaria (the West Bank) and East Jerusalem in 1988. Jordan shows no interest in attempting to try and restore - as far as is now possible - the status quo existing in these areas at 4 June 1967.

Israel’s attempts to “end the occupation” of these areas in 2000/2001 and 2008 were rebuffed by the PLO.

Perhaps it is time for a new slogan - “Right the Wrongs” - to enter into the lexicon of international diplomacy in the Middle East.

The wrongs involve the failure of the United Nations to acknowledge the following incontrovertible facts:
(i) that the provisions of Article 80 of the United Nations Charter reserve to the Jewish people the right to reconstitute the Jewish National Home in Judea, Samaria and East Jerusalem in accordance with the provisions laid down in article 6 of the Mandate for Palestine
(ii) that Security Council Resolutions 242 and 338 remain the only internationally accepted basis for resolving the conflict in former Palestine

The failure of the United Nations to insist on these basic tenets of international law being implemented, respected and observed has proved to be the main stumbling block to resolving the Jewish-Arab conflict.

Yasser Arafat himself declared before the United Nations on 13 December 1988:
"Our people do not want any right to which they are not entitled and which is not compatible with international legality and laws. They are not seeking any freedom that encroaches upon the freedom of others or any destiny that negates the destiny of another people"

Bowing to extreme pressure from the Arab League and the Organization of the Islamic Conference - the United Nations has succumbed to a myriad of General Assembly resolutions since then that have virtually buried such “international legality and laws”.

It is time for international law to be resurrected, debated and enforced as the only basis for ending the conflict in former Palestine.

The sooner this process is begun - the sooner some sanity will return to the Middle East.

Palestine - UNESCO Rebuffs, PLO Huffs And Puffs

The PLO application seeking admission of Palestine to the UN has been dealt a serious blow - after 86 of its 193 members failed to support a mirror application for Palestine to join UNESCO.

The poor UNESCO majority vote recorded in favor is even more remarkable when one excludes the 56 Islamic member States - whose vote to recognize Palestine’s admission to UNESCO was always assured. Only 51 of UNESCO’s remaining 137 members were prepared to publicly out themselves in support of the PLO application.

Any of the four following reasons could be possible explanations for this rebuff to the PLO and could signal a similar disastrous outcome when the UN deals with the Palestine issue later this month:
1. Member States were concerned that any favorable UNESCO decision would be in breach of Article II (2) of UNESCO’s constitution- which only provides for States to be admitted to full membership.
2. Palestine does not possess the attributes for statehood required in customary international law and codified in article 1 of the Montevideo Convention 1933.
3. Palestine could have chosen an easier and less controversial option by applying for associate membership of UNESCO as a territory which was not responsible for the conduct of its international affairs under Article II (3). Such an application - however - would have been an admission that Palestine was not a state - dooming the UN application to almost certain defeat.
4. The UNESCO vote came just days after PLO Chairman - Mahmoud Abbas - sought to appease the UN by admitting that the Arab refusal to accept the 1947 UN Partition Plan was a “mistake“.

Non-supporters of Palestine’s admission to UNESCO would have had serious reservations after hearing Abbas’s untruthful and misleading remarks to Israel’s Channel 2 on 28 October:
“At the time, 1947, there was [General Assembly] Resolution 181, the partition plan for Palestine and Israel. Israel existed. Palestine diminished.”

Arafat was clearly misrepresenting the situation in 1947 since:
(i) The partition plan was not for Palestine and Israel. It was for partition into a Jewish State and an Arab State
(ii) Israel did not exist in 1947.

Abbas however had every reason for stressing that Palestine had been diminished by 1947 - since 78% of Palestine had been granted independence by Britain in 1946 when it was permanently placed under Hashemite control and re-named the Hashemite Kingdom of Transjordan.

Britain’s action was in flagrant violation of article 5 of the Mandate for Palestine - which required Britain to see that no Palestine territory should be ceded or leased to or in any way placed under the control of, the Government of any foreign Power.

The PLO has never accepted Britain’s decision.

Article 2 of the PLO Charter still insists that Israel, the West Bank, Gaza and Jordan is one separate and indivisible territorial unit that must be liberated.

Not content with reminding those listening that the PLO still coveted all of this area - Abbas then attempted to ameliorate its intransigent stance in rejecting the 1947 partition plan by stating:
“It was our mistake. It was an Arab mistake as a whole. But do they punish us for this mistake for 64 years?”

This statement must have sent shudders through the UNESCO waverers.

Abbas was being totally untruthful in failing to acknowledge that the Arabs had from 1948 to 1967 to correct their 1947 mistake - after six Arab armies had invaded a “diminished Palestine” and Jordan had ended up occupying the West Bank and East Jerusalem whilst Egypt had occupied Gaza and all the Jews then living in those areas had been driven out.

Blaming Israel for 19 years of Arab failure to do anything to create Palestinian statehood could explain why many states did not support the push to recognize a fictitious Palestine now.

Abbas had already blotted his copybook when he told Dream 2 TV on 23 October:
“First of all, let me make something clear about the story of the ‘Jewish state.’ They started talking to me about the ‘Jewish state’ only two years ago, discussing it with me at every opportunity, every forum I went to – Jewish or non-Jewish – asking: ‘What do you think about the “Jewish state”?’ I’ve said it before, and I’ll say it again: I will never recognize the Jewishness of the state, or a ‘Jewish state.’

This clear repudiation of the 1947 UN Partition Plan calling for a Jewish state indicated a resolute refusal to ever live in peace with its Jewish neighbour - making the possibility of the two state solution an impossible dream to accomplish.

Such a display of unadulterated racism and hatred could have also weighed heavily on the minds of many UN member states as they failed to support Palestine‘s admission to UNESCO.

The preamble to the UNESCO Constitution requires the Governments of the State Parties to declare on behalf of their people:
“That since wars begin in the minds of men, it is in the minds of men that the defences of peace must be constructed;
That ignorance of each other’s ways and lives has been a common cause, throughout the history of mankind, of that suspicion and mistrust between the peoples of the world through which their differences have all too often broken into war; “

Believing Palestine could ever respect and honor these lofty principles after Abbas’s remarkable statements during the few days prior to the UNESCO vote could have been the final nail in the coffin for so many states voicing their displeasure and failing to support Palestine’s admission to UNESCO.

The fact that the PLO still was refusing to enter into direct negotiations with Israel to peacefully resolve the creation of a Palestinian State- preferring instead to take unilateral action at UNESCO and the UN - could be another explanation for the poor vote recorded in UNESCO.

Whatever happens from here on in at the UN - the UNESCO vote shows that the UN vote will not be the cakewalk predicted by the PLO.

The PLO can huff and puff - but a large number of the UN members have made it clear they are not prepared to be blown down in the process.

Palestine - Sarkozy Makes Monumental Mistake

France’s President - Nicolas Sarkozy - has made a mistake of historic proportions - possibly dashing any hope of the two-state solution between Israel and the Palestinian Arabs coming to fruition - after he told the French magazine Le Canard Enchaîne:
“It is silly to talk about a Jewish state,”

President Sarkozy made this comment while referring to the Israeli demand that the Palestinian Arabs recognize Israel as the Jewish state in any peace agreement.

He compounded this act of gross political ineptness by continuing:
“It would be like saying that this table is Catholic. There are two million Arabs in Israel.”

On the figures alone - President Sarkozy is demonstrably wrong.

Latest statistics show the Arab population of Israel is 1,610,000 (20.5%). The President also fails to mention that the Jewish population numbers 5,874,300 (75.3%) and there are 323000 not identified as Jews or Arabs (4.2%).

Tables cannot be offended - but people certainly can.

President Sarkozy’s statement is extremely offensive to the overwhelming majority of Jews wherever they live - but no doubt will be met with resounding applause by Jew-haters world wide.

His statement will offend those tens of millions of Christians who support the right of the Jewish people to establish their own independent state in their ancient ancestral and legally recognized homeland.

President Sarkozy in this one brief comment has abandoned French foreign policy pursued over the last 90 years - whilst also rejecting international law principles formulated during that period - which France was instrumental in establishing.

In so doing, President Sarkozy has caused great damage to France’s reputation and honor,

It was France - together with Britain, - that laid down the legal framework for the Jewish people’s right of return to Palestine pursuant to the Treaty of Sevres signed on 10 August 1920 - which allocated 99.999% of the captured Ottoman Empire to the Arabs and provided for the remaining 0.001% be set aside as a national home for the Jewish people.

Article 95 of the Treaty specifically provided:
“The High Contracting Parties agree to entrust, by application of the provisions of Article 22, the administration of Palestine, within such boundaries as may be determined by the Principal Allied Powers, to a Mandatory to be selected by the said Powers. The Mandatory will be responsible for putting into effect the declaration originally made on November 2, 1917, by the British Government, and adopted by the other Allied Powers, in favour of the establishment in Palestine of a national home for the Jewish people, it being clearly understood that nothing shall be done which may prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country.”

France endorsed this decision together with all other 50 other countries in the League of Nations by unanimously approving the creation of the Mandate for Palestine in 1922 - which recognized:
“the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country”

France signed the UN Charter on 26 June 1945 and subsequently ratified its coming into operation on 24 October 1945.

The Charter contains article 80 - which preserved the rights vested in the Jewish people under the Mandate - to ensure they did not disappear with the pending demise of the League of Nations - which finally occurred on 12 April 1946..

France was among the 33 countries that voted in favor of the UN Partition Plan on 29 November 1947 calling for the partition of Palestine into a Jewish State and an Arab State.

President Sarkozy is apparently unsympathetic to Israel’s demand to be recognized as the Jewish State - despite the fact that Article 20 of the Charter of the Palestine Liberation Organization denies the Jews any such right in the following dismissive and highly offensive terms:
“Claims of historical or religious ties of Jews with Palestine are incompatible with the facts of history and the true conception of what constitutes statehood. Judaism, being a religion, is not an independent nationality. Nor do Jews constitute a single nation with an identity of its own; they are citizens of the states to which they belong.”

The Chairman of the PLO - Mahmoud Abbas - is a frequent visitor to Paris and is received with full honors by President Sarkozy who can now only be seen to be openly endorsing this despicable and racist viewpoint - which Chairman Abbas resolutely refuses to change.

Hamas is as equally strident in wanting to destroy the Jewish State.

How can a peace agreement between Jews and Arabs be successfully concluded whilst such attitudes are maintained by the PLO and Hamas? What effect will President Sarkozy’s viewpoint have in encouraging the PLO and Hamas to maintain their rejectionist stances? Should President Sarkozy not be urging the Palestinian Arabs to accede to Israel’s request if they ever hope to attain their own independent State?

President Sarkozy needs to read and digest what David Ben-Gurion told the United Nations Special Committee on Palestine on 7 July 1947:
“What is the meaning of a Jewish State? As I told you before, a Jewish State does not mean one has to be a Jew. It means merely a State-where the Jews are in the majority, otherwise all the citizens have the same status. If the State were called by the name “Palestine,” - I said if, - then all would be Palestinian citizens. If the State would be given, another name - I think it would be given another name, because Palestine is neither a Jewish nor an Arab name. As far as the Arabs are concerned, and we have the evidence of the Arab historian, Hitti, that there was no such a thing as “Palestine” at all: Palestine is not an Arab name. Palestine is also not a Jewish name. When the Greeks were our enemies, in order not to annoy the Jews, they gave different names to the streets. So, maybe the name of Palestine will be changed. But whatever the name of the country, every citizen of the country will be a citizen. This is what we mean. This is what we have to mean. We cannot conceive that in a State where we are not in a minority, where we have the main responsibilities as the majority of the country, there should be the slightest discrimination between a Jew and a non-Jew.”

Until President Sarkozy unequivocally retracts his comment and embraces Ben-Gurion’s statement - he will surely be tarred with uttering one of the most damaging comments ever made by a head of state on the Jewish-Arab conflict - effectively prolonging the dispute rather than helping to resolve it.

Palestine - Telling The UN Some Home Truths

Israel’s Prime Minister -Benjamin Netanyahu - has announced his intention to address the United Nations General Assembly in New York this week in connection with the proposed application by the PLO for recognition of a Palestinian Arab State along the 1949 armistice lines.

The terms of the proposed resolution remain a closely guarded secret. There still appears to be disagreement between Palestinian Arab leaders as to its final terms.

However notwithstanding such uncertainty Mr Netanyahu announced at a press conference with visiting Czech Prime Minister Petr Nečas, that he will at the United Nations:
“speak the truth to those who want to hear it”

There are at least six basic truths that need to be conveyed to the delegates of the 193 member states present who are charged with voting on any proposed resolution :1.
1. Mr Netanyahu needs to repeat the following statement he made to the UN General Assembly on 11 December 1984 :
“Clearly, in Eastern and Western Palestine, there are only two peoples, the Arabs and the Jews. Just as clearly, there are only two states in that area, Jordan and Israel. The Arab State of Jordan, containing some three million Arabs, does not allow a single Jew to live there. It also contains 4/5 of the territory originally allocated by this body’s predecessor, the League of Nations, for the Jewish National Home. The other State, Israel, has a population of over four million, of which one sixth is Arab. It contains less than 1/5 of the territory originally allocated to the Jews under the Mandate…. It cannot be said, therefore, that the Arabs of Palestine are lacking a state of their own. The demand for a second Palestinian Arab State in Western Palestine,and a 22nd Arab State in the world,is merely the latest attempt to push Israel back into the hopelessly vulnerable armistice lines of 1949.”

This still remains the strategy behind the current PLO application to the UN. The Palestinian Arabs could have had their State in more than 90% of the territory situated within the 1949 armistice lines had they accepted either of the offers made by Israel in 2001 or 2008. They want 100% to deny Israel the security it needs - as was recognized by the UN in Resolution 242 This message needs to be repeated - especially for the 34 member States who were not members of the UN when Mr Netanyahu made this speech.

2. The view often expressed in the UN that Jewish settlements in the West Bank are illegal in international law ignores the fact that close settlement by Jews on West Bank land, including State lands and waste lands not required for public purposes was to be encouraged and is legally sanctioned by the Treaty of Sevres, article 6 of the Mandate for Palestine and article 80 of the UN Charter. Denying this vested legal right by unilaterally passing a resolution that seeks to negate the exercise of that right breaches article 80 of the UN Charter and is a denial of natural justice.

3. Security Council Resolutions 242 and 338 are the only legally enforceable resolutions of the United Nations binding on all parties to the Jewish- Arab conflict. These resolutions call for secure and recognized boundaries to be determined by the parties to the conflict. This can only be done in negotiations and not imposed unilaterally by any decision of either the General Assembly or the Security Council unless both Resolutions are repealed or amended. To do otherwise will bring the United Nations into disrepute, cause it to lose its authority and render its future rulings and decisions without force or effect.

4. The 1947 UN Partition Plan called for the establishment of a Jewish State and an Arab State in the balance of the area of the British Mandate still controlled by Great Britain in 1947 - after 77% of the Mandated territory had been granted independence by Great Britain in 1946 as an exclusively Arab state and was renamed the Hashemite Kingdom of Transjordan. The Arab rejection of the UN partition proposal and the failure by the Arabs to create such a State between 1947-1967 must require the General Assembly to stipulate that recognition of any Arab state in 2011 is conditional upon recognition of Israel as the Jewish state in the balance of the land contained in the 1947 Partition Plan.

5. The PLO Charter - article 2 - declares that Palestine within the boundaries it had during the British Mandate is one indivisible territorial unit. Until this clause is unequivocally and irrevocably deleted from the Charter - the UN should not consider any application for recognition made by the PLO.

6. The Montevideo Convention 1933 prevents any consideration of the current application - since the proposed state does not fulfill the requirements of the Convention setting out the conditions for a State to possess before it can make a declaration of statehood and then seek to be recognized.

The UN should be seeking to enforce international law not subvert it.

The UN has learned from bitter experience in 1947 what can happen when the General Assembly proposes a solution to the Jewish-Arab conflict which one party accepts and the other party rejects.

Hopefully history will not be repeated in 2011. This will depend to a great degree on the final wording of any resolution. If it is not acceptable to both parties then violence and bloodshed is sure to follow.

The UN really needs to decide whether international law or the law of the jungle is to prevail.

Mr Netanyahu said in his press conference that the General Assembly is not “the place where Israel generally gets a reasonable hearing,” but it was nonetheless important to present Israel’s position.

The real question is - will anyone be listening or have they already made up their minds?

Palestine - United Nations Needs Reality Check

Speculation continues to mount that the United Nations (UN) will be approached in September to unilaterally recognize a Palestinian Arab State in the West Bank and Gaza for the first time in recorded history - without regard to considering the right in international law of the Jewish people to reconstitute the Jewish National Home in the same area.

America is expected to veto any such move in the Security Council and the matter is then slated to go to the General Assembly for discussion and to possibly pass a resolution recognizing a 22nd Arab State.

It is absolutely vital for the UN to conduct a reality check before it makes any such decision.

It needs to be mindful that such a decision could lead to the outbreak of hostilities between Israel and the Palestinian Authority who have unsuccessfully sought to resolve sovereignty in the West Bank and Gaza for the last 17 years in accordance with the Oslo Accords and the Bush Roadmap - and lead to the termination of both of these negotiating processes as a result of any such recognition by the UN.

The following matters need to be taken into account:
1. Any attempt to recognize such a state must accord with international law - in particular the Montevideo Convention 1933. On any reading of this Convention the conditions precedent to declaring such a state cannot possibly be met by the Palestinian Authority, the PLO, Fatah or Hamas.

2. The territory claimed is part of the territory which Jews were given the vested legal right to settle under article 6 of the Mandate for Palestine and article 80 of the UN Charter. For the UN to act in contravention of its own Charter as well as Security Council Resolution 242 would be disastrous for world order, peace and upholding the rule of law.

3. Applying the legal principle of unjust enrichment - the UN should refrain from passing any resolution recognizing any such Palestinian Arab State for the following reasons:
(a) Such a state was rejected by the Arabs - but accepted by the Jews - when offered by the Peel Commission in 1937 and by the United Nations itself in 1947

(b) No such state was created between 1948-1967 in precisely the area now being claimed - despite all the Jews living there having been expelled in the 1948 War following the invasion of Palestine by six Arab armies. Such a state could have been created at any time in those 19 years by the simple stroke of an Arab League pen

(c) Offers by Israel in 2001 and 2008 to cede its claim to more than 90% of the territory were rejected by the Palestinian Authority

(d) Recognizing such a state without a concluded peace agreement will not end the conflict

(e) 500000 Jews presently living in the territory would be under threat of annihilation or expulsion in gross violation of their rights under international humanitarian law

(f) The Palestinian Arabs have refused to abide by international law as Article 20 of the PLO Charter makes clear:
“The Balfour Declaration, the Mandate for Palestine, and everything that has been based upon them, are deemed null and void.”

(g) Great Britain was forced to finally relinquish its Mandate in May 1948 after Great Britain’s Secretary of State for Foreign Affairs had declared in a speech to the House of Commons on 18 February 1947:
“His Majesty’s Government have been faced with an irreconcilable conflict of principles. There are in Palestine about 1,200,000 Arabs and 600,000 Jews. For the Jews the essential point of principle is the creation of a sovereign Jewish State. For the Arabs, the essential point of principle is to resist to the last the establishment of Jewish sovereignty in any part of Palestine. “
This racist attitude has been maintained unchanged for the last 130 years and is the root cause of the inability to end the conflict. Until the PLO and Hamas revoke their Charters calling for the destruction of Israel - the UN should refuse to entertain passing any resolution recognizing any Palestinian Arab state.

(h) The UN should reflect on the consequences of the refusal of the Arabs to accept the 1947 UN Partition Plan as detailed in the following summation by Great Britain at the time:
“This plan was accepted in principle by the majority of the Jews, but the Arabs announced their intention of resisting it by every means within their power and were promised full support in their resistance by Egypt, Iraq, the Lebanon, Saudi Arabia, Syria, Transjordan and the Yemen. While this plan was still being discussed, and before the vote was taken. His Majesty’s Government repeatedly emphasised that, in the absence of agreement by both Arabs and Jews, they would not themselves enforce it and announced their intention to withdraw all British forces from Palestine by 1st August, 1948.”

The threat to world peace ever since and the hundreds of thousands of dead, injured and traumatised victims - both Arabs and Jews - over the past 63 years should not be rewarded by granting what was available and rejected in 1947 and the following 19 years.

Only direct negotiations between Israel and the Palestinian Arabs or another Arab interlocutor can now resolve the conflict. Too much water has passed under the bridge since the Palestinian Arabs frittered away the 20 year window of opportunity to have their own State.

The UN should insist the parties return to the negotiating table without preconditions and continue negotiating under the Oslo Accords and the Bush Roadmap or any other proposal that is mutually acceptable as the basis for negotiations.

Attempting to unilaterally impose a solution without the consent of both parties is a recipe for disaster and will open the UN to similar demands from the myriad of independent and secessionist movements around the world that have been struggling for self-determination in the backyards of many of the UN member States for many decades.

The membership of the UN in 2011 is very different to that existing in 1947. In 1947 there were only 57 members of the UN of whom 33 voted in favour of the Partition Resolution, 13 voted against, 10 abstained and 1 was absent. Today there are 193 members and each has one vote.

They should ponder very carefully how that vote should be exercised and the consequences for world order and peace - and perhaps even the future of the UN and their own existence - if they make the wrong choice.

Palestine - Lawyers, Hot Air And No Clothes

John V Whitbeck - described as “an international lawyer who has advised the Palestinian negotiating team” - has recently written an article published in Al Jazeera pointing out that 106 members of the United Nations have now recognized the State of Palestine, whose independence was proclaimed on 15 November 1988.

Whitbeck also tells us that such recognition covers between 80-90% of the world’s population.

Behind these apparently impressive statistics and the conclusion that Whitbeck draws from them - the story is strikingly different.

Whitbeck’s claim of international recognition is pure window dressing bereft of any clothes. It amounts to hot air and nothing more.

What Whitbeck claims as fact is fiction, a state that exists in the mind rather than in reality, an ideal eagerly sought without any current prospect of being achieved.

The declaration of independence proclaimed on 15 November 1988 by Yasser Arafat was nothing more than a public relations stunt since the Palestine Liberation Organization then controlled not one single centimeter of former Palestine. Such declaration sought to be justified on the basis of the United Nations 1947 Partition Plan that had recommended division of Western Palestine into separate Jewish and Arab States. That recommendation had been unanimously rejected by the Arab League. Relying on it 41 years later seemed a hypocritical exercise in diplomatic peace making.

A large part of the world was however prepared to forget and forgive the Arab aggression that followed the rejection of the 1947 UN recommendation and grasp this 1988 lifeline in a further effort to bring about a resolution of the conflict between Jews and Arabs. It has proved to be a waste of time in achieving what the Declaration sought to supposedly accomplish.

Whitbeck further reveals the fantasy world in which he is living when he states:

“While still under foreign belligerent occupation, the State of Palestine possesses all the customary international law criteria for sovereign statehood. No portion of its territory is recognized by any other country (other than Israel) as any other country’s sovereign territory, and, indeed, Israel has only asserted sovereignty over a small portion of its territory, expanded East Jerusalem, leaving sovereignty over the rest both literally and legally uncontested.”


Whitbeck’s claim is a load of arrant nonsense.

The criteria for recognition of a state in customary international law were codified in Article 1 of the Montevideo Convention signed on 26 December 1933 which provide as follows:

“The state as a person of international law should possess the following qualifications:
(a) a permanent population;
(b) a defined territory;
(c) government; and
(d) capacity to enter into relations with the other states.”


1. There is indeed a permanent Palestinian Arab population living in the West Bank and Gaza.


55% of the West Bank Arabs live in 17% of the West Bank under the exclusive administrative and security rule of the Palestinian Authority (known as Area A) and so could be said to exist within a defined territory. 100% of Gaza and its entire Arab population is under the administrative and security control of Hamas and so would also meet the first two criteria.

2. However such a State possesses no government.


Relations between Hamas as governing authority in Gaza and the Palestinian Authority as governing authority in the West Bank. are at rock bottom. Arab League efforts to effect a rapprochement continue to founder. Death, torture and false imprisonment continue to mark the three years long internecine struggle between the two governments to win the hearts and minds of the West Bank and Gazan Arab populations. Neither has the capacity to enter into relations with other states. Both of these criteria for statehood are non-existent and their fulfillment appears a hopeless dream.

Whitbeck’s claim of international recognition of the State of Palestine is therefore meaningless - other than to indicate this is a result the world would like to see.

But that was also the world view in 1947 when the Arabs then rejected an Arab State in an area much larger than the one contemplated by even the most optimistic of today‘s recognizing States.

Whether any such an option in any kind, shape or form is available in 2010 - given the new facts created by 500000 Jews now living in the West Bank and East Jerusalem - appears increasingly to be fated to consignment once again to the garbage bin of history.

Any suggestion that the West Bank be entirely cleared of its Jewish population would be a preposterous notion that has no place in the current interpretation of international humanitarian law.

America. Russia, the European Union and the United Nations have been actively involved in trying to overcome these obstacles during the last seven years - but all to no avail. There is no prospect on the horizon that this situation will change.

Whitbeck’s claim that Israel has only asserted:

“sovereignty over a small portion of its territory, expanded East Jerusalem leaving sovereignty over the rest both literally and legally uncontested”


is another self-serving piece of propaganda and is completely removed from reality.

It completely ignores Israel’s legal right to establish the Jewish National Home in both the West Bank and Gaza under the Mandate for Palestine and article 80 of the United Nations Charter. Sovereignty in the West Bank and Gaza resides in neither Jews nor Arabs at the present time. Sovereignty in East Jerusalem has been claimed by Israel but not internationally recognized. Efforts extending over the last 17 years to determine sovereignty in all these territorial areas have been unsuccessful.

Israel’s claim as sovereign owner of the whole or part of West Bank and sovereign ruler of East Jerusalem cannot be summarily dismissed or written off by the pathetic bleating of a former adviser to the Palestinian negotiating team.

Indeed one could reasonably conclude that with advice such as this - it is no wonder that the Palestinian negotiating team have been indoctrinated into believing that they are entitled to continue to claim sovereignty in 100% of Gaza and the West Bank as well as East Jerusalem to the total exclusion of Israel’s claim.

As one saying goes - “I can only act on my lawyer’s advice”.

As another saying goes - “I think you better change lawyers because the advice being given to you by your current adviser seems to be way off the mark”

Whitbeck’s conclusions on the international recognition of the State of Palestine are not worth the paper they are written on.

Brainwashed Or Brain Dead?

Editor: When you read Marty Morrison's article you will see how Goebbels was right: in claiming that if you repeat a lie often enough, it is believed. I did what we all have to do when this happens and responded to her anti-Israel article with "just the facts", just the provable facts, point by point.

Hats off to the Independent Australian as well for publishing both the article and my response.

Marty Morrison's article ‘Marty In Palestine’ (9.11.2010) contains factually false and/or misleading statements, contends David Singer.

1. “The sympathy that the world community had for Jews following the horrors of World War II blinded people to the dispossession of the Palestinians.”

In fact world sympathy for the Jews had been established after World War 1 with the creation of the League of Nations Mandate for Palestine in 1920 calling for the “reconstitution of the Jewish National Home” in Palestine after thousands of years of exile, anti-Semitism and pogroms.

The Arabs have never recognized this unanimous and binding legal declaration by the League and this has been the source of their misfortune ever since.

2.” historians say the Palestinians have inhabited the land between the Mediterranean Sea and the Dead Sea for more than 13 centuries.”

There was no designated group called “Palestinians” until 1964. During the 400 years rule of the Ottoman Empire (1519-1919) the population was divided into “Jews”, “Moslems” and “Christians”. This practice continued during the Mandate (1920 -1948). The Mandate document itself only referred to “the existing non-Jewish communities”. The UN partiton Plan (1947) only spoke of a "Jewish" state and an "Arab" state.

3. “In 1917 at the time of the Balfour Declaration Palestinians comprised 70 per cent of the population and owned more than 90 per cent of the land.”

The Arabs only owned 8% of the land and the Jews 6%. The rest was state land vested in Turkey and forming part of the Ottoman Empire.

4. “One way to do this is to stand with the Palestinians and Israeli activists when homes are being destroyed, when more Jewish settlements are being constructed on Palestinian land”

Homes have been destroyed pursuant to court decisions ruling their construction illegal or as a result of the application of Jordanian laws still applicable in the West Bank. The land is not “Palestinian land”. It is at this point of time "no man's land". Its legal status is that it forms part of the remaining 5% of the territory of the Mandate for Palestine still unallocated in accordance with the terms of the Mandate. Jews are legally entitled to settle anywhere in the West Bank under article 6 of the Mandate and article 80 of the UN Charter.

5. “One can understand the Palestinians’ frustration and apprehension for the future when one considers that when the United Nations partitioned Palestine into two states in 1947 the Jewish state received 55 per cent of the land and the Arab Palestinians and Christian Palestinians got 45 per cent of the land”

More than 70% of the 55% offered to the Jews comprised the arid and sparsely populated Negev desert. The 45% offered to the Arabs was mostly the fertile and contained the majority of the Arab populated areas. The Arabs rejected the UN offer as they had previously done in 1937 when rejecting the Peel Report recommendations.

The Arabs could have had what they now demand in 2010 - at any time between 1948-1967. Had they been prepared to negotiate and recognize Israel in the five years following the 1967 War the political landscape today would have been entirely different. Their refusal to accept less than 100% of the West Bank and Gaza over the last 17 years and their expressed desire to destroy Israel has seen their position further deteriorate.That is their prerogative but it is a bit late to cry over spilt milk. Their leaders have led them – and apparently well intended persons such as Marty – up the proverbial garden path.

6. “In the ensuing war the Israelis captured even more land, so that at the cease-fire the Jews were in control of three-quarters - leaving just 22 per cent of land for the Palestinians (the West Bank and Gaza)."

The Jews only controlled 17%. Jordan controlled 83%, which it unified into one country with the consent of the West Bank Arabs in 1950. Only Great Britain and Pakistan recognized that reunification. The Arabs could have created a separate state out of that 83% at any time between 1948-1967 but did not do so and did not request one. They were the architects of their own missed opportunities.

7. “The boundary at this time came to be known as the Green Line.”

There was no boundary – only an armistice line that had been in existence following the end of hostilities in 1949.

8. “After the war in 1967 the Israeli army conquered all of Mandated Palestine”

Incorrect. 78% of Mandated Palestine had been granted independence in 1946 and was not conquered by Israel in 1967. The West Bank (Judea and Samaria are the Biblical names for this area) and Gaza – conquered by Israel in 1967 – was only 5% of Mandated Palestine.

9.” I hate to write this but I firmly believe that Israel, by and large, wants the Palestinians to disappear and are therefore deliberately colonising the West Bank”

Israel is clearly failing in this “objective” if Marty only took the time to look at the increasing West Bank Arab population and improvements in their standard of living. Since 95% of the West Bank Arab population is now under total Palestinian Authority administration after the Oslo Agreements in 1993. Marty's “firm belief” is a load of nonsense and amounts to racial vilification,

10. “Jews are invited to come to live in the West Bank from every country on earth.”

Why does this worry Marty? Jews have this right legally granted to them under the Mandate and article 80 of the UN Charter. They had done this prior to 1948 before they were driven out of the West Bank by six invading Arab armies.

11. “Settlers live freely without any of the curtailments of the Palestinians”

The Jews live behind barbed wire and stringent security restrictions with their schools and public places all under security guard protection and for good reason.

12. “I realise that the burden of my account is at odds with the information supplied by the skilled Israeli public relations officers and government ministers.”

Marty's account sure is. She appears to have relied on a whole lot of dishonest material given to her by her Arab hosts. It is a pity she didn’t check the veracity of this material before rushing into print. Had she done so she might have had a better perspective on the conflict between Jews and Arabs that has gone on for the last 130 years.

Palestine - Passover And Perfidy

Jordan’s King Abdullah - in talks with British Foreign Secretary David Miliband on 8 April - highlighted the importance of the role of Europe and the world community
“in pushing forward the peace talks between the Palestinian and Israeli sides towards the establishment of a just peace based on relevant UN resolutions and the Arab peace initiative.”

according to a royal court statement [RTT News 9 April 2009]

The King’s failure to include the Annapolis process - begun in 2007 - as part of such peace talks certainly amounts to an admission by him that Annapolis has been effectively dead and buried so far as he is concerned. He is to be congratulated for his recognition of the end of a process that was doomed to fail from the day it was announced.

His Majesty needs to elaborate on what he meant by the term “relevant UN resolutions”. Another royal court statement explaining and elaborating what resolutions King Abdullah had in mind would help clarify and explain his rather vague and presently unchallengeable remark.

The King was more precise in urging Europe and the world community to push forward the peace talks based on the Arab peace initiative.

However His Majesty is well aware that the Arab peace initiative - dreamt up by Saudi Arabia and endorsed by the Arab League in 2002 - has been rejected by Israel. He also knows that the initiative has been offered on a “take it or leave it basis “ by the Arab League preventing Israel making any possible amendment or modification to its terms.

King Abdullah’s current call for serious negotiations on the basis outlined to Mr. Miliband is therefore just a lot of hot air with no substance whatsoever. His present call will do nothing to help bring an end to the conflict between Jews and Arabs over the West Bank and Gaza- an area of land that once comprised 6% of the territory formerly called “Palestine“.

It was no doubt pure coincidence that King Abdullah’s meeting with David Miliband occurred on the eve of Passover - the Jewish festival celebrating the deliverance of the Jews from Egyptian slavery and bondage .

David Miliband might therefore do better to focus on the real nature of the current dispute that caused him to meet with King Abdullah by considering the following statement of David Ben Gurion made to the United Nations Commission on the Partition of Palestine in 1947

“Three hundred years ago a ship called the Mayflower set sail to the New World. This was a great event in the history of England. Yet I wonder if there is one Englishman who knows at what time the ship set sail? Do the English know how many people embarked on the voyage? What quality of bread did they eat? Yet more than three thousand three hundred years ago, before the Mayflower set sail, the Jews left Egypt. Every Jew in the world, even in America or Soviet Russia, knows what kind of bread the Jews ate - Matza. Even today the Jews worldwide eat Matza on the 15th of Nisan. They retell the story of the Exodus and all of the troubles Jews have endured since being exiled, saying: This year, slaves, next year, free! This year here - Next year in Jerusalem, in Zion, in Eretz Yisrael. That is the nature of the Jews.”


If David Miliband does not have the answers to the Mayflower questions posed by Ben Gurion then he has a large department of public servants to help him find the answers.

Mr Miliband would however certainly be well aware of the perennial call made by the Jews - “next year in Jerusalem “ - that inspired the Balfour Declaration in 1917 calling for the “establishment in Palestine of a national home for the Jewish people”.

The League of Nations subsequent conferral on Great Britain in 1922 of the Mandate for Palestine gave recognition “to the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country”.

Few would have thought that just three months later 77% of Palestine would be closed by Great Britain to Jewish settlement and the establishment of the Jewish National Home and that the sovereign Arab State of Jordan (Transjordan as it was then called) would eventually be created on that major proportion of the territory of Palestine - free of any Jews whatsoever - just 24 years later.

This perfidious act by Great Britain in 1922 was dictated at the time by Arab pressure - as was an equally perfidious act in 1939 when Great Britain restricted the entry of Jews into Palestine - the prospective Jewish National Home - at a time when a safe haven for all Jews fleeing Nazi persecution was urgently needed.

Now once again 87 years later Arab pressure demands that a second Arab state be created on the remaining 6% of former Palestine - the West Bank and Gaza - where sovereignty still remains unallocated between Arabs and Jews.

Great Britain has been prepared to turn history and international law on its head to encourage and support such a demand which has been impossible to achieve after 16 years of wasted diplomatic effort to make it occur. Arab intransigence has ensured - and will continue to ensure - its failure

David Miliband needs to take King Abdullah aside and quietly ask him one question :

“Your Majesty you now are the ruler of Jordan - 77% of Palestine - which we the British conferred on your family in 1922 and subsequently granted independence to in 1946. When will Jordan be prepared to enter into serious negotiations with Israel as the two successor States to the Mandate for Palestine to resolve the issue of sovereignty in the West .Bank and Gaza and so finally complete the division of Palestine into two sovereign States one Jewish - Israel and one Arab - Jordan?”

If he can get a definitive answer from King Abdullah Mr Miliband will have gone a long way to finally ending the conflict between Jews and Arabs over sovereignty in the former territory of Palestine and completing the work left unfinished when Great Britain handed back the Mandate to the United Nations in 1948.

No doubt Mr Miliband will find it hard to get a direct answer from King Abdullah. But he needs to do so if the current international demand for a “two state solution” is to have any meaningful or realistic hope of ever eventuating.

Meanwhile Jews the world over will continue to eat Matza and express thanks that they have been spared to personally see the reconstitution of the Jewish National Home in its biblical homeland with Jerusalem as its capitol after 2000 years in exile and its continued existence as the one and only Jewish State in the world.

Palestine - The Lieberman Factor

It has not taken long for media commentators to jump on the bandwagon and label the biggest winner in the Israeli elections - Avigdor Lieberman - as an “anti-Arab politician” (Scotsman 12 February) and a person “who holds abhorrent views” (Telegraph 12 February).

This form of generalised character assassination should be rejected and the media should be required to justify the policies of Lieberman that lead to those kind of general comments and labelling to be made.

The Telegraph has totally misrepresented and distorted Mr Lieberman’s policy in relation to resolving competing Arab and Jewish claims to the last 6% of the land once called Palestine - the West Bank and Gaza - in which sovereignty still remains unallocated between Arabs and Jews more than 60 years after the other 94% was divided between Israel and Jordan.

Mr Lieberman’s policy on this issue was stated by the Telegraph in the following terms:

“Mr Lieberman thinks that what we call the “peace process” has been a mistake from the start. Put simply, Mr Lieberman rejects every facet of President Barack Obama’s thinking on the Middle East. When the nationalist leader has real power in Israel, the country could find itself on a collision course with America’s new administration.


The following official policy of Lieberman’s party - Yisrael Beytenu - however tells a different story:

“Trading Spaces Moving The Border Between Us, Not Among Us.

The responsibility for primarily Arab areas such as Um-Al-Fahm and “the triangle” [presently in Israel - ed. comment] will be transferred to the Palestinian Authority. In parallel Israel will officially annex Jewish areas in Judea and Samaria [the West bank - ed. comment]. Israel is our home. Palestine is their home.”


This policy does not reject - indeed it confirms - President Obama’s thinking on the Middle East calling for a “two state solution” involving the creation of a new Arab State in the West Bank between Israel and Jordan.

Lieberman is not the rejectionist politician on “the peace process” that the Telegraph would ask its readers to believe .

Lieberman and Obama are clearly united in wanting a two state solution to the conflict resulting in the creation of a 22nd Arab state between Israel and Jordan.

Lieberman’s policy affirms that Yisrael Beytenu does not support Israel’s return to the 1967 armistice lines - incorrectly called “the 1967 borders” by the Telegraph. This particular use of incorrect terminology - embraced by Arab negotiators - serves as a stark reminder that you don’t always believe what you read.

Lieberman is not unique in embracing this policy.

His view is shared by:
1. every major political party in Israel,
2. President Bush and the former Israeli Government in the Roadmap negotiations and
3 is enshrined in United Nations Security Council Resolution 242.

President Obama will not retreat from this position, ignore the Security Council Resolution and demand Israel cede 100% of the West Bank to the Palestinian Authority. The facts on the ground will simply not allow this to happen. 500000 Jews cannot be kicked out of their homes in the West Bank.

Indeed the reality is that no two state solution can possibly happen until the Arabs accept the inevitability that there will be no return by Israel to the 1967 armistice lines.

President Obama will need to bring the Arabs to this realisation if he is to succeed where President Bush failed. Given the intransigent stance by the Arab League on this issue for the last 40 years it would indeed be a miracle if he could bring about a change in Arab thinking on this fundamental issue.

Lieberman’s policy to cede Israeli sovereign territory to the Palestinian Authority that presently contains solely Arab residents in exchange for Israeli sovereignty over West Bank land that presently contains solely Jewish residents has come in for a fair amount of unjustified criticism.

Yet this policy calling for the separation - as far as is practically possible - of the Jewish and Arab populations has been at the heart of every proposal for partitioning Palestine between the Arabs and Jews since the Mandate for Palestine was first formulated in 1920.

It was the same policy that led to the United Nations Partition Plan in 1947.

The Peel Commission in 1937 eloquently summed up the benefits of partition in the following terms:

“The advantages to the Arabs of Partition on the lines we have proposed may be summarized as follows:—

(i) They obtain their national independence and can co-operate on an equal footing with the Arabs of the neighbouring countries in the cause of Arab unity and progress.

(ii) They are finally delivered from the fear of being swamped by the Jews, and from the possibility of ultimate subjection to Jewish rule.”

“The advantages of Partition to the Jews may be summarized as follows:—

(i) Partition secures the establishment of the Jewish National Home and relieves it from the possibility of its being subjected in the future to Arab rule.

(ii) Partition enables the Jews in the fullest sense to call their National Home their own; for it converts it into a Jewish State. Its citizens will be able to admit as many Jews into it as they themselves believe can be absorbed. They will attain the primary objective of Zionism—a Jewish nation, planted in Palestine, giving its nationals the same status in the world as other nations give theirs. They will cease at last to live a minority life.”


Lieberman’s policies tread well established precedents for resolving the Arab - Jewish conflict in former Palestine.

Perhaps media like the Telegraph should take the time and make the effort to read and understand Lieberman’s policy rather than engage in sensationalist journalism that only hinders rather than enhances the prospect of a resolution of this ongoing conflict between Arabs and Jews.
